Lots of stock images, lots of not stock images.  Will only be posting the ones that aren’t stock in the gallery – you can figure out which few images are theirs (spoiler alert, it’s not hard to figure out).  I don’t recommend stealing from ANYONE but definitely don’t steal from photographers that are local to you.

They’ve removed most of the stolen work from their website but the Facebook still has a lot of stolen images.  I’m also adding in some of the stock images from their various places on the internet including on their business profile pages since the owner is claiming that it’s his “partner” that stole the images, all he did was use the images he was given.  Too bad some stolen images are on the owner’s Facebook profile.

A lot of stock images are on Facebook alongside their own work.   Not only is it generally against the TOS to use stock imagery to represent your own work, it’s really dishonest as well especially when paired up with lines about the session.

      My business page is 100% organic and has 2,500 fans, you’ll often see “seen by 50” with 1 like, if that. I have another page with 350,000 fans and posts get 2-3 likes.

      So don’t be fooled by the horrendous way facebook know runs things.

        could be a lot of reasons… he could have done it on purpose to show off his editing skilz (highly unlikely) or it could be due to any number of software issues resulting from stealing someone else’s edited photo, cropping/resizing, than re-upping it to his site. All those things tend to downgrade/resample the image, so depending on quality settings and/or image formats, color shifts and saturation changes could happen unintentionally (the more likely scenario).

        The black isn’t as rich as it is in the original and he compressed the model when he made the image square, so my guess is, if he didn’t scan this from a magazine, he just has shitty Photoshop skills.

        But since it is always against the tos to falsely claim ownership, the real photographer can always sue his ass.

          Not only is claiming ownership against their ToS, using the images on Facebook is also against their ToS.

            Getty’s new ’embed’ licensing agreement really looked to me as if they were throwing in the towel after all the bad press they were getting for going after blogs and others for copyright infringement.

            Their former response to IP theft was threatening looking demands for payment from their legal department. They rarely made it all the way to court: “According to records compiled by Bloomberg Law, Getty has only filed seven copyright infringement lawsuits in the past five years. Of those, five came in a single week this January.” (from Businessweek.com)

            The gist of it is that most people are complaining about huge licensing bills they are getting for using images they ‘found’ on the internet and didn’t know were copyrighted (duh) and a common explanation is ‘I took them down once I found out’ (sound familiar?)

            Obviously, the case above is of another magnitude, I am sending an email to Getty to ask how they deal with a case like this.

        Good news is, a Bing search gives this site top billing when searching for Visible Air in Cleveland. I don’t know the percentage, but it has to be MOST people at least do a google / bing search before handing money over to a photographer (even a fake one).

    React with anger, go into denial, or start in with the threats. We already have the evidence against you. The best thing you can do for you is to be honest and to deal with this head on.

    2. Flag comments on this listing. The mods will just put them back, so don’t waste your time.

    3. Lie or offer excuses. We have heard every excuse in the book (really, we have. One guy even blamed Obama.), and you will not come up with something we haven’t heard before. You are not a special snowflake. Nothing you can say will justify what you did, so don’t bother.

    4. Accuse us of slander (because nobody ever figures out it has to be verbal to be slander). We stick to the facts, and if something is publicly available, it’s fair game.

    5. Create fake accounts to defend yourself. We will see through it, and it’s just a waste of time.

    Please DO the following:

    1. Remove any and all stolen images immediately. That means now. Right now. And no, simply hiding them from public view doesn’t count. They need to be completely deleted.

    2. Apologize DIRECTLY to those from whom you have stolen (and tell the truth!), and offer monetary compensation. You used their images in a professional setting to try to make money, so you owe them that much.

    3. Hope they don’t sue you. Copyright infringement is illegal under the law, and you can be sued for thousands of dollars, if not hundreds of thousands of dollars, for EACH stolen image. Yes, seriously.

    4. Apologize publicly, on all the sites and social media accounts where the stolen work appeared. Again, you owe it to your clients, fans, friends, etc., to be honest.

    5. Learn about how copyright works. Look up the Digital Millenium Copyright Act. What you may think you know and what is actually the truth are probably two different things (as in: no, posting someone else’s photo as “inspiration” is not a valid reason, nor is it good enough to provide credit. If you don’t have express permission to post someone else’s image, then you don’t post it. That’s it, the end).

    6. DON’T STEAL. It’s not complicated — if you didn’t take a photo and don’t have permission to use it from the actual copyright holder, then don’t use it. It’s that simple. Yes, seriously. You claim to be a photographer, so why on earth would you want to use others’ images, anyway? How does that make sense?

    And remember:

    1. If you do it again, you will be caught. We go back and check old listings to make sure they haven’t started stealing again. And don’t forget — Google knows. Anytime someone searched for your business, this listing will come up.

    2. Think about the actual victims here (no, not you) — those whose images you stole. You screwed them over. And frankly, that’s a pretty damned crappy thing to do. And think about the clients you’ve mislead by presenting a false front. They’re victims, too.
