It finally happened, someone was silly enough to steal an image of mine and put it in their portfolio.

PS:  If you interrupt the opening night of Deadliest Catch by stealing my images, I will be angry.

PPS:  You know how much I hate fake stories?  Yeah, this one has them.

After almost an entire day without a peep from Julie aka In a Flash Photography, she finally posts to her Facebook Page about the incident.   Note that Julie has shut down her Facebook Page so that only people in Canada can see it.  Guess what Julie?  I have friends in Canada!

Yep,  she actually is claiming that I stole the image from HER.   Ballsy.  Too bad I can prove the image is mine.  

The day that I took this image and the REASON I took the image that Julie of In a Flash Photography in Toronto stole is because the day of the engagement session a group of terrorists decided to try and blow up that bridge in the image.  During our engagement session, local news stations were covering the story.  It just happened that Newsnet5 captured me taking this very image during their live broadcast.  See the screen capture below where I’ve circled myself and the couple I was working with.

Just in case there’s still any remaining doubt here’s the RAW file and a few of its friends from this session.  I’m still waiting to hear back from the other photographers but I imagine they’d be able to show the same kind of proof.

Last night Wix removed In a Flash’s website completely so now we’re down to just the Facebook Page that is still live  but she’s made the settings so that only people in Canada can view her page.    Here’s her recent update from her Facebook Page.

I had a feeling this was going to move into the typical “bully” and “death threat” stage so I started screen capturing everything posted to her page from the moment I posted this blog to the moment she blocked all outside of Canada from seeing her page.  Not one death threat or anything remotely close to one.

Very few things surprise me anymore when it comes to those that are featured on Photo Stealers.  However, Julie is in a league all of her own.

Original source ME!  Ironic backstory to this image: that bridge was nearly blown up that day and not only can I prove this image is mine by the usual methods (RAW file, clients and so forth) but there’s actually video of me by the local news station taking the image below as they covered the breaking news story live.

      I can’t since they are in Canada but what I can do is make a post and DMCA their website host. Wix is really great about taking sites down that violate copyright.

        I wonder if you actually do have some IP rights or legal recourse in Canada…maybe this is one area where NAFTA might actually benefit the little guy? Just thinking out loud…It might be worth looking into w/ a call or email to a Canadian IP atty or the Canadian Consulate.

        It is good that Wix is good about taking down violators. I just wish there was a way to hold them more accountable.

          Fair enough, but considering it’s Cory’s photo and I’d like to think she’s a thoughtful intelligent human, I don’t see her photographing in those conditions. Any jerk-off on this website, not so much. :)

            BTW, I love that shot.

            I know we aren’t responsible for the idiocy of others and it’s their problem if they don’t take the proper steps/precautions and get the proper authorizations but you have to admit that when people don;t even bother to understand the basic laws governing their industry (like copyright) the odds are they are to f’ing stupid to think about things like trespass and safety.

            Also, I agree with you on the guy getting kicked unfortunately he;s set to make a considerable sum of money from his stupidity. YouTube revenues and he’s licensed the video to a media company. :(

            If you watch the video you’ll also see that they were close to me the whole time. I used that whole perspective thing-a-ma-jig to make it look like they were far away. Of course I groaned when of all images they steal one of the few times I’ve been on tracks!

      It’s all good – I wouldn’t normally shoot on them but a) it’s the only way to get the bridge in that picture b) that track is for a line that only runs for special events on weekends and generally only a few times a year and we weren’t there on a weekend or during The Polar Express season c) the track was completely offline due to the FBI investigation that day.

I told her to read some of the other entries and see how well it went when people lied, denied, and fought the truth and make her choice. Let’s see what she does.

        I’ve recently had that discussion with a potential client who tried to negotiate me down (and mind you I do this on the side, so I don’t need the money luckily) based on what someone else (not a bad photographer, just very green/basic) was offering price-wise.

        I simply said, “I can appreciate your attempting to get the best value for your money. Unfortunately, I do not negotiate my prices as I feel my prices properly reflect the quality of photography you will receive. You will see, generally, that in this industry, you get what you pay for. I encourage you to compare my photos with any other photographer you are considering and make the selection you feel is best for you and your expectations.”
        I did not get them as a client. But I feel good about it. And I got a referral to another client (a friend of theirs) who DID hire me at the price I wanted to make it worth my “outside of my day job” time. :)

          I don’t do photography, but I have people in my line of work looking to get “deals” on my prices. If they have something I need they can barter for, I am game, but otherwise I stick to it, or you can go across the street to where your “deal” will give you nothing but a low quality result. Some of them come back eventually. ;)

        I would suggest having the images pop up to large size with a mouse over them, so they don’t have to go to a new page to be seen. However, I’m not the one running this site on my limited free time with only a few donations here and there to keep it going, so I’m fine with this, as are most people. The record of the theft and the outing of the thief is the most important thing here.

            I’ll admit it, I’m a webmaster by day and photographer by night/week-end (do about 12 weddings a year plus a bunch of other stuff like maternity, boudoir, portraits, events … some product).

            My main job is Communications Officer / Webmaster for a Federal Department.

            Whenever my director insists on having mouse over capabilities (no matter how much I tell him that’s it’s not good for usability), I also include code to intercept clicks for mobile. Works fine.

        i was *really* confused with the old one when i stumbled across it a while ago.

        the biggest problem is with the larger fonts, and spacing, that everything is ‘verticalized’ without a very immediate distinction of -who is the offender -what are their info -what is the original -what are proof of original.

        the way it is right now everything is run-on.

        perhaps, “box” things in with a colored background. [e.g. red = all pertaining to offender; blue = all pertaining to claimant]. use different sized fonts or italization for comments.

        also, the page doesnt use up the width of my display. but i understand this is somewhat complex in webpage design. the biggest point is that everything is “unitized” and i dont know whats what

    I just loaded the main website this morning, a good 12 hours after this story broke, and I surprised to see the front page slideshow still displaying the stolen images in question, including the kissing bride/groom and the railroad tracks shot.

    Of course, I’m always freaked out when they put stolen pictures of children up on Facebook and make up new names or little stories.

    This woman is NOT a real photographer. Chances are, she’s just a divorced house mom (with no offense to house moms) with a camera who simply got a bit too excited and didn’t realize that on the internet, you really can’t just do whatever you want and get away with it. Ten years a professional? No way. She may have bought her first digital point-and-shoot 10 years ago, but her Rebel is barely out of the box. Unfortunately, this story is now, too, so hopefully she will do the right thing and actually APOLOGIZE in the same uninhibited way in which she deceived.

I’m sure they’d be interested to hear about the ethics of one of their senior employees. Shameful. Julie, if you’re reading this, which I sincerely hope you are, this web site (Photo Stealers) is going to be on google for all eternity, with your business name attached to it, and perhaps at some point, your full name. If I were you, I’d get moving on removing all of the offending photos from all of your sites, and then come back over here with a HUGE apology.

    I finally took a moment to look at the Facebook page. Seeing the pictures that she really DID take herself, I completely understand her desire to steal those belonging to others. They are HORRID. No skills or understanding whatsoever. Like many (though not all) photo stealers, she simply did not bother to actually LEARN any real photography skills.

    Dear Julie of In A Flash Photography of Toronto, Canada: you can steal photos, but you can’t steal capability. What happens when someone sees the beautiful pics of “Kayden” and “Hong” and all those other children who’s portraits you stole and passed off as your own, and hires you to provide the same, and then you end up only giving them that amateurish crap you’re limited to?

    Shame on you!

    This is seriously funny to me. (Stealing one of PS’s shots aside) Ya know how you picture a photostealer in your head, and as you are looking you think “yep, no wonder they felt the need to steal, their work is crap” or “Damn! Are ANY of the photos on their site theirs?!”
    She’s a double whammy. What was/is she thinking?! lol it’s pure silliness.
    It always makes me wonder what their real lives are like when people pretend this hard about somthing like photography. What else do they pretend?

      You hit the nail on the head. I’ve been concluding as of late that photo stealing is simply a symptom of other issues at hand, as opposed to isolated behavior. It’ll end up being the case here, too, if much at all is ever known about this whack job — I mean, woman.

        Well so far I see three types:

        The fly-by-night fakers (Brett and Jizelle) who are just trying to turn a buck ANYWHERE possible, with no real artistic interest in the process or results of their own work. These guys typically have multiple “businesses” all that are easy to set up, and easy to fake.

        The Wanna-Be: The person who wants to actually be a legitimate photographer, but lacks the skill and knowledge, as well as work ethic, but instead of working to improve, buys an expensive camera and sets up shop and steals to improve their portfolio. (Flickers Photo)

        The Praise Seeker: They steal other people’s work so they can garner attention and “likes”, and enter contests with other people’s work to gain even more attention. They might be a hobbyist or blogger, MAYBE a “business” but it seems the one thing they really want more than anything is attention.

      Yep. And a good indication, too, that there’s “issues” behind just the photo stealing. Putting aside just the photo theft, all the other stuff is disturbing behavior for any individual, but even most especially for someone who openly advertises themselves as a “mother of three”. It’s still a bit early, so it give time and eventually some really strange stuff is going to come out, I’m betting.

      I’m curious, too, how whackjobs such as her would feel if someone stole pictures of HER children from her Facebook page, and then renamed the boys, adding tales about knowing them or how describing the photo session. I feel pretty certain that “freak out” would be an anticipated reaction.

        I think it’s the same moral disconnect that the religious people have. If SOMEONE ELSE stole, they would be all up on that person quoting scripture, but when it’s them, they were just “inspired” by it, because stealing is for bad people, and THEY are not BAD!

        LIkewise I think if it was one of her kids she would be pretty pissed at the thief, but in her mind, I can bet anything, she didn’t steal a damn thing, because it was “free” on the internet.

      I find it concerning from a safety point of view that she may try and recreate some of the newborn photos in “her” portfolio too, and be completely incapable or unaware that shots like that tend to be composites.

    I’d love to see her do a photo shoot and totally botch the thing. Then watch her try and explain herself to a judge of why there is such a difference from the images on her web page to her current work. I saw Judge Joe Brown (I know it’s tv) rip apart a photographer. The “professional” shot the wedding with a digital rebel and the kit lens. Yes you can get stunning work with a kit lens and a digital rebel. She didn’t. And when asked about more professional bodies and lenses, she told the Judge she owns a Canon 1Dx but left it at home that day. The judge and I both almost fell out of our chair. So she owns a $6,800 camera and shot a wedding with a camera and lens together costing $800. I’m not buying it. And neither did the judge. I hope this woman gets what’s coming to her.

    I can’t believe they’re still doing it. I contacted a photographer in Maryland whose photo – the baby in a swing – she is using in her portfolio. As a portrait photographer who had to start my own portfolio from scratch by shooting friends, then clients, I find this type of ripoff stupendously lazy and fraudulent.

    This girl is crazy!! She JUST posted this on her FB page (time 4:00pm, April 23, 2014) :: “Dear friends and parents of little cuties.. On this beautiful day I had a big issue with haters coming to my website, stealing my photography and calling it theirs and calling me horrible words.

    I am very saddened to have previously not taken action against those who have used my imagery without consent, feeling it to be a complement to my work.

    Unfortunately I cannot stop people from having ugly hearts and shameful words. I can though, assure you that my photography is mine.

    I can also assure you that I don’t post images I have not taken..especially of my own children – the nerve that these people have is mind boggling, and I apologize if their words have hurt you in any way, posted under your children’s sweet faces.
    Some of these people went as far as trying to see where I live and I am now looking into various measures to handle this situation.

    To the parents who have called me and asked to please hide their children’s photos – I apologize from the bottom of my heart! I will follow up with all of you!

        1. What does a typical Thursday look like for you, starting from when you wake up – to heading to bed?

        With the arrival of my little munchkin Liam three weeks ago, my Thursdays have been starting with seeing my husband off to work and going through the typical baby routine. Once Liam and I are comfortably parked in the nearby park, with a cell phone in one hand and notepad in the other, I continue to dedicate my efforts towards the planning of a Fashion Food & Wine charity gala event, coordinated with the Canadian Cancer Society.

        As a Business Analyst by profession, my life has been greatly affected with the struggle and passing away of my dear mother in law to cancer. Since then, I have devoted my time to a goal of raising cancer awareness and aiming to raise funds towards finding a cure for cancer one day.

        As Liam is snoozing away, I coordinate the work of the dedicated volunteers who have in one way or another been touched by cancer, and whose responsibilities range from marketing to fundraising, model management to donor relations.

        2. What was your first job out of school?

        My first job was with a large financial institution, which prepared me for my career in Information Technology. Working as an accessibility assistant, I not only learned about the existing types of software that aide individuals with disabilities, but was also brought face to face with some inspiring personalities who continue to persevere with limitations such as blindness, dyslexia and others.

        3. What are the 3 skills you require most to do your job well?

        I believe that any job requires interest and enjoyment within the capacity of one’s profession. Attention to detail and dedication are definitely necessary as well.

        4. What do you love most about your career?

        I love the interaction with others on a professional level. I believe that every person has his or her own approach, and it brings me satisfaction knowing that I can communicate well with others.

        5. Do you have any warnings?

        Always stay true to yourself and believe in the goodness of others.

          Interesting how these friends somehow think that it’s just all about “hate” coming randomly from people who have no lives, as if it’s a gang of thugs who just happen across someone that might be a tasty victim. Obviously, the trust their friend and put their faith blindly in her. No one wants to believe their friend is a fraud. But facts are difficult to dispute. And the fact it, I’ve seen Corey’s evidence that she is the original author of that photograph, and I’ve seen no evidence whatsoever that the accused photo stealer is the author. I’ve seen evidence that baby pictures were on the web a least a full year PRIOR to the time in which the accused photo stealer claims she created and posted them. And though admittedly more subjective, I’ve seen photos the accused has taken of her own children, and they are of a VASTLY different quality, demonstrating far different skill sets, than those in question.

          This woman will likely hang on to her story as long as she has friends who will profess their belief in her, regardless of the evidence.

      While I certainly understand the desire to help defend a friend or help someone you think has been falsely accused, I think that these enablers don’t seem to realize how much they are actually responsible for this issue.

      Let me walk you through it:

      First, it’s people like the above ‘defenders’ who start this all off by telling someone how great and talented they are with little or no criticism. This soon becomes ‘you should do this professionally’ advice freely given by someone who has no concept of what is actually required to be a professional. The fauxtographer then starts a photo ‘business’ and quickly finds themselves in way over their head.

      Next thing you know they are ‘padding’ their websites and social media accounts with work they can only dream of producing in order to live up to their friends’ expectations. With their limited experience, skill-set and equipment, neither they or their friends can actually understand the wild discrepancy in quality, so rather than admit to ignorance they both pretend it’s some combination of luck and magic.

      To keep up the charade, they start inventing stories for their friends and clients.

      They get caught. They are now in so deep, they have to keep the lie going. Their friends get caught up in the social media melee and start to feel foolish or under attack for being associated with the fraud and double-down by defending what is obviously indefensible. The fauxtographer now has a choice: come clean, risking losing friends and clients and opening themselves up to charges of fraud and being know locally as a liar, or keeping the lie going hoping that only ‘haters’ and invisible internet-meanies will be the only ones who know the truth.

      Moral of the story: FRIENDS don’t let real friends LIE. Not to themselves, not to their friends (internet or otherwise) and certainly not to clients who pay them.

      Be a real friend. Help Julie out of this mess by coming clean, don’t just help dig the hole deeper.

    If any of Inaflash’s defenders happen to read this: I understand your desire to want to defend someone you feel is being unfairly attacked. But I ask for you to look at the evidence before making that judgment. There is instance after instance of others’ photos on her site which have been around on other photographers’ sites longer than Ina Flash has even been in business.

    Corey Ann can clearly prove she took her image. The news was there when she did it, plus she has the RAW files, as you can see further up on this page. Those RAW files would not exist if she didn’t take the pictures. Ask Inaflash to do that. They can’t.

    The evidence is there, and it’s not even a little bit ambiguous. Please, I ask for you to be reasonable and look at everything. This site does not need to manufacture evidence, and it’s very easy to prove it on your own.

    We are not “haters” (whatever that means). We simply want to see people be held accountable for their actions. In this case, Inaflash engaged in copyright infringement, which is illegal, not to mention immoral. Take a step back, assess the situation, and I think you’ll see things differently.

      It’s ironic that in all my years on the internet I was never labeled a ‘hater,’ accused of bullying or threatened until I started following and posting here on PhotoStealers.

      It’s amazing how quickly your skin thickens when you have so much objective evidence on your side. It really just saddens me to see how prevalent bad behavior is, and just how important it is to take a stand against it.

      I don’t buy it. Where are the screen shots of these threats? Where is the proof she contacted the police? Why did she keep her Facebook account open only to those in Canada?

      It is very common for photo thieves to play the victim card after being outed. After all, it’s shameful and humiliating to be called out for doing something so egregiously wrong. But of the dozens of people who have been caught here and claimed to have been threatened and bullied, not a single one has every been able to furnish any sort of proof to that effect. One person even went so far as to show screen shots of their e-mails, but none of them actually contained any threats. They all simply called out the fact that the person had stolen photos.
      Of course, nobody here (myself included) would ever condone theatening behavior or bullying. But simply drawing attention to the stolen photos or demanding an acknowledgement and and apology from the person are NOT bullying or threatening.
      Your friend continues not only to deny that she has done anything wrong, but also has gone so far as to accuse the original photographers of fraud and stealing. Can you understand why that may have upset some people? The best course of action for Julie is to own up to her actions and apologize, and make restitution to those who have been really harmed by her actions.

      Those threats are very likely not real. Rather, they were invented in order to shore up a world built on lies and delusions. I understand if you don’t believe that outright, but you do yourself and your friend an injustice to not at least consider the possibility that she has invented this image of herself as a victim. Look carefully at the evidence showing a huge pattern of lies designed to portray herself as a master photographer. Then carefully consider the mentality that would created that world in the first place. A pattern appears. This woman needs sympathy, but not as a victim of online bullies. Rather, she needs mental help. The safe world she created around herself collapsed and she’s lashing out at those who brought it down. By supporting her delusions that she is a victim, you’re only going to hurt her more.

      Why can’t she admit that she has done wrong? And she has done wrong by infringement of copyright and theft. If someone stole your car, put a few hundred miles on it, then returned it, would you be appeased? Not to mention that Julie is accusing the other photographers of stealing the photos that she herself stole, after fabricating back stories for them.

      I also find it hard to believe that anyone from this site would have sent any message like the ones she claims above. Altogether the people frequenting this site are a bit more eloquent, although with a sense of humour, even when matters get heated.

      What Julie needs is counsel. Someone to sit her down and get her to admit that what she did was wrong and get her to snap out of this alternate reality she has created for herself. If she truly believes she took the photos above then she requires significant psychological help, which I would hope that someone so fervently defending her would encourage her to get.

      The “Threats” if any were given, were most likely cease and desist statements telling her to take down what does not belong to her. She’s trying to turn things around in her favor. Just like when she said she was contacted by parents asking that their children’s photos be taken down. She finally realized she had to take down the stolen works, and was afraid if anyone noticed that she did, they would ask questions as to why, so she came up with a story. Of course she didn’t know that her family and friends would most likely accept things regardless of how she handled herself, and if she had handled it more properly and honestly all the “haters” would have ALSO accepted her actions. But, I find, and I’m sure others here as well find how she is handling herself and the situation she has created UNACCEPTABLE and insulting. The claim of threats are also a story to make her look more favorable. My children sometimes do this sort of thing when they are caught with their hands in the cookie jar, only I see through it and am actively trying to correct this unwanted and unacceptable behavior, just as my parents taught/corrected me.

      Considering this is the same woman that is claiming we stole all of the images above from her and she just allowed us to keep them on our websites because she took it as a complement I doubt the death threats are real. If you reload the blog you will see an update above where I showed comments that were posted to her site that she’s claiming had death threats and bullying.

        I remember a stealer who took screen shots to try to show proof of the “bullying”, “Threats”, “defamation”, and “slander” once. I don’t recall which one, but they claimed to have received death threats and all sorts of nonsense. They took screen shots of cease and desist letters, and comments that stated “This photo doesn’t belong to you. Take it down. Why did you steal other’s hard work?” and the like, and some that just linked to the PS blog. Yeah, it didn’t go over as well as they expected. Maybe to THEM having the truth pointed out to them, and being told what they are doing is illegal and unethical and how to correct the situation they created, seems like bullying because it’s the first time anyone has ever cared enough about them, or what they do, to criticize them and try to correct them? It’s really kind of sad when you think about it.

      As others have said, this is not a victimless crime. She used others’ photos intending to make a profit by pretending those images were hers and booking clients based on those photos. That is illegal. And now she is blatantly lying about everything and threatening to file police reports against those from whom she stole. I very much doubt those threats are real, as she has already proved herself to be a liar. Even if they are (and I by no means condone anyone making personal threats against her), the fact remains what she has done is illegal and she has yet to own up to her actions. The photos were not taken down by her, they were forced down by the copyright owners contacting the sites where they were hosted.

      I’m calling bullshit on these so-called “threats”, and probably to the police report, too. They are only as real as her bullshit photo sessions with “Kayden”, “Hong” and all the other children she never met.

      We are always cautioned about playing psychologist, but it should not require a degree to see that this woman is genuinely mentally ill, most likely schizophrenic. She invented a reality for herself, one that was supported by her friends, and that reality was disturbed by strangers. Now, those strangers are haters, the friends are enablers, and the woman is a “victim”.

      Most often, these photostealers are entertaining to a degree. But this woman is just plain sick. It’s like watching someone bleed out and no one is there to help.

        I don’t recall seeing ANY death threats to this woman, let alone involving children, and I am with you on doubting their validity, and that she is contacting the police about it…. because if she did, it would not take long for the police to deduce she was not only in the wrong, but that she is a liar. On some base level she must know this.

        ALSO, there is not much the police can do about threats like that, even if they existed. The police barely take legitimate, physical stalking seriously until something violent happens. Internet “trolls” can hardly be “policed” (especially from other countries) merely recorded.

        There is definitely something off with her…. but I’ve seen these types before. It comes with being a fly-by-night business owner, as well as being someone who relies on a partner to provide the majority of their income. There is this disconnect between their false reality, and the real world. They aren’t frauds and thieves they are just like everyone else, but with “haters”. They always feel genuinely prosecuted when they are outed. They become so involved in the fantasy of who they are and what they have “accomplished” that it becomes a way to cope, and essentially becomes their real life, ignoring the fact that the accomplishments are lies, and the person they have created is a lie.

        One of the reasons I love this blog is because it is such a fascinating window on these personality types. They are very reminiscent of munchausen by internet, and catfishers, just less extreme, because there is such an ingrained level of fantasy, that the denial becomes unbelievable to the normal, functioning human.

        Actually Amy from Amy’s Baking Company is a good example. She knows she buys her desserts from CostCo…. but in her reality, they are homemade, and she does it all, despite the fact that her kitchen isn’t even equipped for baking what she displays.

        I think liar, possibly pathological, is the most that can be deduced from this scenario. However, schizophrenia is a very complex diagnosis and to my limited knowledge (just taking a 2nd yr abnormal psych course here) schizophrenics do not invent their own realities. However, I am not defending her actions in anyway. She is clearly in the wrong. I would not be surprised if the threats are real (internet flaming/bullying is at epidemic proportions), but that would not excuse her actions either. I guess time will tell on the police report, though there may never be any published results on that even if she really did file it. It seems just as likely that this is a ploy to continue to garner sympathy and avoid addressing the proof of the accusations.

            What gets me is that the spouses don’t put the hammer down on this bullshit. Maybe it’s because I am a moral human being, but I’d be pretty damn quick to notice if my significant other was suddenly posting shoots I KNEW she didn’t have, and that the quality of her photos went from mediocre to amazing overnight.

            She needed it to come crashing down, if she is ever going to change. The page lost almost ALL of it’s “likes” since this happened, and people have politely contacted all of the businesses that have “liked” her page, so they know as well. I don’t think she will ever take accountability, the ones like this rarely do. I am sure that Lisa from Flickers Photography still believes she did nothing wrong.

He probably hasn’t got a Scooby Doo what she’s been up to, and now the pictures have been removed, he probably thinks she is 100% innocent.           Indeed, while she hasn’t given any examples I don’t think it is unreasonable to assume that they likely exist. This is the internet and it is full of trolls and assholes that latch on to things like this. Rather than make calm, intelligent comments based on the evidence at hand they send threats. It happens all of the time. Sadly it is hard to do anything to stop them. It does frustrate me because there is really no need to act this way, she clearly does not own the photos she is using, the evidence speaks for itself. Sending out posts like that, threatening to kill her etc does not help.

        I’m with Michael. I think the threats are just made up and she is so far down this path of deception that she is hoping that deleting all evidence and claiming a conspiracy will keep her ‘friends’ from looking too deeply and will keep them on her side.

        Likely at this point she is more afraid of losing face in the real world than she is about a lawsuit or losing business, which I doubt she had much of in the first place.

        THAT is why we are still interested in keeping this alive… as long as she remains in denial and keeps blaming others, she will just continue the lies, even if it’s just to save face.

    I know how many of us would like to see these fakers/thieves be taken through a proper course of justice via the law/courts. Corey Ann has more than sufficient evidence and proof of copyright infringent here. Not sure if a watermark was removed or if the image was LOC registered but this is still an open and shut case. Just a matter for the court to determine damages. With the traction and publicity this case has gotten on PetaPixel and Reddit i know that Corey could definitely get the donations needed to secure an attorney to start the process. I sure hope this is one we continue to hear about all the way through. Could it be a perfect example to the people who refuse to believe/accept what the copyrighy laws really are and how they work?

      If she was in the US I’d already have a lawyer lined up. Being that she’s in Canada and I’m in the US things are a bit more tricky. I need to do some more research to see what my options are and if it’s even feasible to do. It may end up not being worth the cost since this image wasn’t registered so I can’t recoup lawyer costs (if that even applies out of the country).

        I’m not sure the cross-border issue is such a problem. I’ve never had to deal with this sort of thing, so I don’t know for sure. But I have spent a lot of time in Canada, as well as other countries (I have immediate family in Toronto), and the laws there aren’t really much different. It seems to me it’s just a question of hiring a Canadian lawyer, is all. Copyrights exist there just like they do here. And she violated them by Canadian standards, too.

          Darren: US laws don’t apply in other countries and yes, the laws are very, very different. For example, copyright damages are capped quite low in Canada and thus we’ve not seen the extortion methods of music and film studios in Canada.

          My suggestion is that she reach out to Michael Geist as he’d probably very happy to help out and get a blog entry about it. Another place to look for coverage is Spark on CBC Radio 1 as that show covers tech and copyright issues.

            Thanks, Andy. Yes, I understand that US laws don’t apply to other countries (or vice versa). But copyrights and trademarks are generally respected universally. If you pirate an American movie and show it at a theater in Toronto, you’ll still get shut down by Canadian authorities and sued for copyright infringement. Hell, you’d even get shut down by Chinese authorities if you tried that in Shanghai (although enforcement is certainly more lax there).
            But I agree that those are good contacts to reach out to there.

    I’ve just been informed that at least one of my images has been used on this person’s blog/website as well. Her facebook page is down now. She used my image and cropped out my copyright – and it was a blog image from 2010. I have no idea what actions I can take…. but it really angers me and I’m grateful that someone from here notified me of this.

      If you aren’t in Canada, you might just not be able to see it, as she has made it visible only to people in Canada, and no one seems to be having any luck with proxies to view it. People here from Canada are still informing us about what is going on, so your photo(s) might still be up.

            I wasnt able to get into again after the 1st try using that Chrome App someone listed last night until I just happened to log completely out of Facebook, clear my browser and then log back in. Ive been able to see it all night. Theres nothing going on on it. She hasn’t posted since the bully post and I’m not sure how many Likes she did have but she has 231 right now. If you try the App again, I’ve noticed that it really slows things down. It took me forever to simply log out of twitter cause it was waiting for a server. But it does work.

            Just for grins I downloaded TOR and attempted to log into Facebook. It blocked me and said that my account was locked. I then got an email from Facebook stating that someone attempted to log into my account from somewhere in India. Fascinating! I guess TOR works as advertised!

      Heather, once you can get the link to the photo you can report it to facebook and have it taken down. Her website is gone for good, but you can still send her an invoice for unlicensed usage (industry standard is two or three times standard usage rate)

        Thanks Justin and for the replies. I am in Canada. I have been to her facebook page – it only has images that it appears she has taken which are in huge contrast to the images she had ‘borrowed’. I have someone searching for any other images as well and my lawyer will be informed – but I don’t know if there is much I will do at this point. The Canadian maximum per image (usually a commercially copyrighted image) is $2500 in damages – and with legal fees and the amount of time and energy spent I’m not sure I’m willing to invest that on this person at this point. I find it interesting that she took the time to go back in my blog to posts from 2010 to find the only images that were not ‘non-clickable’ (I.E. could still be right clicked). That takes a lot of perseverance! And of course the image she has is not my favorite image since it is over 4 years old. The principle of it angers me, but I am reminding myself that anything we put on the internet has the risk of being copied, saved and duped by anyone. A good eye opener. I am again, very grateful to you for keeping me informed.

          I completely understand your reluctance to invest time and money when it is you who have been wronged. I mostly suggest that people send an invoice so that the photo stealer knows that there is a value and price attached to what they have done. (Some people have reportedly even been paid, but this doesn’t seem likely with InAFlash). My feeling is that if there is an actual C$ amount attached to the crime, it’s harder to just shrug it off as ‘victimless.’

          All credit really goes to Corey Ann, she is the one who ‘outed’ this woman and does all the hard work around here.

            Justin you’re absoloutely right. It’s easy to shrug it off because nobody wants to invest their time and yet what message is this sending IAFlash, and what’s to say she won’t turn around and do it again? I have a strong feeling she will lay low, find a new name and do the same thing again. She’s lazy and she hasn’t learned photography. She wants a fast easy way to get her ‘needs’ (wants) met – which is usually a personality trait, not just bad decision making on ones part. I know this kind of person.
            I have emailed my lawyer.
            I think based on your reply – I will go ahead and pursue this. If not for the monetary punishment to her, to at least try to give her a lesson of why this is wrong. And the fact that she continues to lie on her facebook page right now bothers me. She has issued a statement that she has received death threats on her children. Understand that I have yet to even contact this woman. But I do question her claims on some level, because believe me that if anyone threatened a hair on my child’s head (if I had children) – I would be taking that very seriously and talking to my neighbor the police chief immediately.
            I will keep you posted – as my lawyer tends not to mess around, which is why I questioned getting him involved. He never takes the ‘lets just leave this alone’ approach….. We shall see..

            I definately think that without a lawsuit she would reoffend. And I hope you DO sue her, and I would say I hope you win… but the case is pretty clear-cut. I hope if it goes forward you keep a log and let us know the results… something perhaps that could be used to point future thieves to….

            I don’t know how similar Canadian and US copyright law is, but I know in the US at least, people are sued for the act of reposting a photo on their blog they don’t own. The original photographer always seems to win too, even though the blog was making no money.

            One thing I want to say about the death threats: She didn’t post any screen-caps, and all of the “threats” were clearly typed out by her, not cut-and-pasted like you would think someone being legitimately threatened would post.

          I think you forgot a zero in there. It’s 25000$ not 2500$ per infraction on top of that in Canada, Legal fees are also usually awarded.

          The “no right-click” scripts are garbage.

          1- Most of those scripts rely on JavaScript … easy to disable.

          2- The link to the image is actually in the HTML of the page so simply using the “dev tools” or “view source code” buttons can still net you the direct url to the image with minimal effort.

          3- There are programs out there that scrape sites to download every single photo on the site. The program get’s the source code, get’s rid of everything that isn;t an image tag, get’s the src attribute from those tags and then downloads the image from that link …at a rate of HUNDREDS of images a minute … all automatically. All the thief has to do is point the tool at a website.

          But if we just throw our hands in the air and give up, they win. They need to be hit and hit HARD! Take them for everything the law allows us to so that they think a second time before trying this again. Our industry is crumbling because of general apathy in regards to our IP. We have to fight this or we won;t have an industry for much longer.

            Thanks for the correction! And yes, if you’re tech saavy it sounds like you can be lazy and do what you like. I shouldn’t have given her credit!
            I heard back from my lawyer. He did say this to me:

            - has she taken business away from you? *she is in Toronto and I am not so no, it is not likely that she has taken business away from me.
            - is there proof that she sold the image and made money off it? *no, it appears that she was using it to make money for herself. Whether she would have generated income? I have no idea. Any client would have been completely bamboozled if booking her considering she would not have the skill set to provide the services she was advertising on her website.

            So that’s his line of thinking – that intellectual property and copyright infringement is not as easy as knowing that someone stole your image, but then showing damages. This would be the tricky part in this matter? I’m open to ideas people!!! Listen, if anyone is going to go ahead with this it’s me. But not if my lawyer isn’t game, so I am going to have to some research on my own if I want him on board…

            I’d like to start by pointing out that I ma not a lawyer.

            I’m confused as to why your lawyer thinks you need to prove actual damages. I believe you are entitled to statutory damages under copyright law. The thief having made sales of your images or not is a moot point. Her use of the images was commercial in nature therefore you are entitled to statutory damages.

            That would be like not going after Coca Cola if they stole one of your image to use in an ad campaign …

            They didn’t sell the image, just used to to generate business.

            Their use of your image would not have deprived you of revenue since you would not have sold it anyways.

            So based on those to points that your lawyer brought up, you would have no case against Coca Cola? Maybe get some advice from another lawyer? One who maybe specializes in copyright law? If you were in the US I would have recommended contacting Carolyn E. Wright, the Photo Attorney … not sure about here in Canada.

    She continues to remove negative comments, and the pictures from the Chinese website are still there. Including captions like “This little cutie was all giggles during the shoot…” – Unless she was on the shoot in China in 2009 (the last updated date on the Chinese website page), I don’t think she would know….
    I left some comments last night, and today they are gone, and I have lost ability to comment further. Good thing I have a few more Facebook accounts to comment with :-)

    Here is the current statement on her FB page stating there have been death threats, a very serious statement/accusation. I also take offense to word bullying being used in this context when there are children actually being bullied and sometimes taking their lives as a result of it. We have to be careful with the words we choose – no matter how desperately we are trying to look for sympathy and avoid taking responsibility for our own wrong doings. If she would have only owned this mess, I would hope that anyone who had contacted her would be satisfied with that.

      InaFlash Photography in Toronto, Ontario stole except for a few and her website is no longer working. The last time she publicly posted on her Facebook was April 24th. So while its not a complete win/win for PS.. its dang close. PLUS Photo Stealers got some media coverage out of it which had to have put some tremendous pressure on Jj Gleizer who owns InaFlash. On the downside.. like most of them who refuses to acknowledge that they are photo thieves..shes probably rebranded and if so her days are numbered til shes caught again.

        Her name is also forever connected to stealing, and the photostealers page. So she can rebrand, but unless she lies about her name, (and even then) it’s always traceable. There is also a CLEAR record of theft and fraud here, in case she gets an unhappy client who would like their money back, and who needs some court evidence, OR of she steals again and finally gets sued.

        I personally wouldn’t want to try to recreate a business after something like this, because you will never know when the other shoe is going to drop and you have to start AGAIN…..
