Generally I don’t feature companies here because honestly, it happens so often.  When a business uses an image without permission your best bet is to contact a lawyer and follow the legal channels.  I’m featuring this particular company because I’m trying to source the images and since I’m doing all of this work I may as well make a post while I am at it.

This is going to have a bit of a different layout due to sourcing of the images, they are everywhere throughout their social media platforms so I’m going to do what I can with sourcing.  As with the other posts, the image on the left is from Vimi, the image on the right is from the original source.  However the image I’m showing from Vimi may not be the only place the image is used.

I’ve been in contact with most of the photographers and none have used this service nor did they give this company permission to use their images.

    They are apparently a company in China. That might make it interesting to deal with. Question, does US copyright apply to a Chinese company?

      Not sure. That could create some difficulties for anyone looking to file a lawsuit.

      My non-lawyer type understanding of international copyright law being what it is (in other words, pretty negligible) you can sue them in the US or Canada but all they have to do is ignore you … that being said they do have US REVENU in the form of App sales through Apple and Google so that could be one vector of attack.

      I’m not sure whether they have to. But they are hosting with Amazon web services. So while the person themselves might be able to avoid any court action or paying out anything, Amazon has to obey US copyright.

      So you just send a DMCA to Amazon web services and they have to pull the content from the site.

    • Yes, they do (legally). Under the Berne convention (of which China is a signatory), they must honor the copyright laws of the origin country (note, there is no such thing as ‘international copyright’, Berne is the treaty that brings us closest to that).

      HOWEVER – enforcement is near to impossible, and its pretty common practice for (some) Chinese firms to rip off patents, copyrighted material, even trademarks. And the PRC seldom enforces this, unless you happen to be Pepsi, IBM, etc. Even then, there are a ton of knock-off Nikes, Prada, etc. that still occur.

      For an independent artists / photographer its like screaming into the abyss…

    If you go into their “like” and trace your mouse along the gray line on the line graph showing new likes it ranges from (mostly) double digits with a bump in the end at “10” new likes. The page was created mid-December 2013 and yet they have over 4500 likes. Anyone else think they’re yet another example of why Facebook is getting worse for photographers? That reason being fakes buying likes and traffic.

  • I sent them an invoice. They are totally free to use my images, but I want paid. In fact, I would prefer this to them taking down the images.
