This submission came to me last week when I was out of town photographing a destination wedding.  Unfortunately this photographer refuses to take down the images and the images remain on her website a week later.

What made me laugh is that not are all of the images watermarked with her logo (I couldn’t find any images on her website that didn’t have a source out on the internet) but that she even stole the buttons from some other photographer – including the “about us” with their photo.

    Ok Synthia Herrera of Synthia Herrera Photography … let’s educate you on the business of photography … specifically copyright violation and circumvention of rights management information as directed by the Digital Millenium Copyright Act …

    Copyright violation fines?
    Up to 150,000$ PER IMAGE.

    Cropped or cloned out water marks? 2,500$ to 25,000$ per image under the DMCAs provisions on circumvention of rights management information.

    So looking at the images above we have something like 39 images. That’s potentially 5,850,000$ in copyright infringement and then another potential 975,000$ for watermark removal.

    Then we get into the commercial use of a persons likeness without a model release for each person in those images.

    Next we hit Fraud / False advertising laws.

    My understanding is that you have been contacted on several occasions about your use of others intellectual property and you essentially told them to f-off … karma.

    • There are three more images on her wedding gallery that are mine. So make that 43 images in total.

      None that I can find. It’s a bit hard to navigate so there may be some somewhere in a buried gallery.

        Not only slow but poorly designed.
        Weird menu options, images overflowing out of its containing divs … just bad.

      • What makes it so painfully slow?! I can’t even spend time looking through. At first I thought maybe there are pop ups, I notice that my devices will kind of lock up if it’s a fishy pop uppy kind of site. Is that why? Freakin horrible! I don’t have the patience to keep trying to load it and navigate it. Props to you PS.

        • I really wondered about that … Even google cache is horrible thought it was my internet service but all else loaded fine.

      Since religion was bound to come up in all of this, I thought I might point out how many of the 7 deadly sins our fauxtographer has already broken:
      1. Greed. Well, obviously.
      2. Sloth. It’s just fucking lazy to steal other people’s work instead of doing your own.
      3. Envy. She WISHES she could ever make images like the ones she’s stolen.
      4. Pride. Even when she didn’t actually win them, she’s happy to claim awards and kudos (see image attached).

      Judging by the amount of images she’s stolen, one could even make a case for 5. Gluttony. I’m gonna give her a pass on 6. Lust.

      My guess is 7. Wrath is on it’s way…

    I am not a big fan of people placing wedding site badges on their Websites that they haven’t earned. I could not find Synthia on The Knot or WeddingWire, but she shows a 2013 and a 2014 award. Maybe she was using a different name… A Google search showed a Synthia Herrera-Crxxx piggy-backing on another CA photographers Website. None of that was to be available until 1/1/16. Going to be nice and not link that in case it’s not the right Synthia. You people know how to Google this stuff. LOL

      Considering her website was registered on August 7, 2015 … I doubt those awards are real unless she has re-branded since.

      they have a photo booth company with a different name, with domain registered in 2013 under husband’s name, so some chance it was the photo booth, but I did a couple of searches on those sites and so far, nothing either under the current name or the photo booth name.

      The awards are not real. I have notified the Knot and Wedding Wire about this and they have reached out to her. All the images on her wedding gallery are mine and the image on her contact page is mine. This image also has a review on it which really makes me mad because I created this testimony. It is from MY client. Synthia is incredibly hostile and refuses to remove my photos and is incredibly rude via email. Unsure what to do next.

        on her website it brings up the contact info and where you can register
        abuse.

        • Thanks for confirming this. This is one idea I had to do. I did look this info up last week and plan on contacting the domain company tomorrow. I am really thankful I have this blog post to help back this up!

        Lawyer up. By law, if you registered the images, she is looking at up to 6 million in liability in copyright penalties. You wont get that but that’s the top potential penalties.

        If she removed your watermark on any images its 2500$ to 25000$ per image under the dmca provisions on circumventing rihhts management information.

        Dont do amytjimg else until you talk to a lawyer.

    Wow, just WOW! She’s not only extremely busy stealing photos, she’s also shilling her photo booth all over her local area groups on FB. Her photography page on FB is gone, but that seems to be recent, as she was posting to groups with it.

    This one’s probably going to try sticking things out. She appears to feel entitled to use others images for her business.

    Synthia Herrera of Synthia Herrera Photography. Frauds such as yourself never end up succeeding. If you must steal and rely upon the work of others in order to attract clients, then you already know that you do not have the skills necessary to accomplish the job of a photographer. But you obviously do NOT understand how serious stealing the work of others is, nor how likely it is that, one day, you will utterly fail to deliver quality services to a paying client, and how they will research and find this board, and then sue you for false representation. (Had you stolen my work, you would be served with a lawsuit already.) That you invoke the name of “Jesus” in your email address only shows further how you are willing to LIE to people in order to fulfill your motives.

    Thankfully, Synthia Herrera of Synthia Herrera Photography, you are now EXPOSED. For me, although it is always sad to see such cheatful conduct, it’s always a joy to see you people fall.

    I knew the year wouldn’t end without another ‘revelation’ but the arrogance of this one is truly astonishing!

    I do hope that those whose images have been so ruthlessly stolen have the time, the perserverance, and the funds to create an example of her. If we could see a widely publicised case when a genuine penalty of several hundred thousand dollars is imposed then it might make others think twice in future.
