Again with the composites.  Sigh.

Update 07/10/2014 @ 11:45AM

When I was originally sent this submission I was getting ready to leave for a mini-vacation and didn’t have a chance to make a proper post.  I screen captured some images and left and started afresh today.  Since Alex is claiming the images he used for compositing came from the book “Compositing Secrets” and were legal to use I figured I’d add in the image that was removed before today that was absolutely NOT stock.  There are also a few other images that were not stock as well.

  • Lindsay11

He is promoting his business ALL over his personal page too so I think that’s good to have it here as well. https://www.facebook.com/burkhalteralex?fref=ufi

And of course he has a gofund me! http://www.gofundme.com/9p4ufw

    • peaceetc

His personal page lists PPA under ‘Professional Skills.’ Why do I doubt he’s really a member?

  • U Really That Dumb?

    Alex,
Did they not cover theft at OSU or at Chandler High? Should we call your teachers there and ask if they covered that?

    • U Really That Dumb?

But wait, you’re still in HS… So you lied again?

      • Lindsay11

You can still be in HS and attend college. I did that. My son is doing it right now. So that could absolutely be true.

      • CrackerJacker

Just a thought: If you’re attempting to do crowd-sourced funding to pursue your passion of photography, you should probably spell it correctly in your plea for money.

  • peaceetc

*sigh* Another one who can’t keep their hands off of others’ stuff. I get wanting to play around making composites or try out different kinds of processing in Photoshop so you download some pictures to mess with, but don’t upload them! It’s not complicated.

    • U Really That Dumb?

He’s 17 and apparently hopped around from HS to HS.

  • KimJ

I dabs the “I didn’t know” card for bingo!

    • U Really That Dumb?

Nope! You are prematurely dabbing! He hasn’t claimed it yet! 🙂

    • Lindsay11

I think that’s exactly what we will hear. I am always interested, but especially in this case, I’d like to know how Corey found him. I assume someone has told him this isn’t ok? (Not that it matters how he was found, I just like to know stuff!) (And he shouldn’t need to be told!)

(Also he defines what a composite is on his facebook, so he knows!)

  • Marc W.
    • Photo Stealers

The original image is actually linked below the tutorial – it’s stock which is linked above from the website section. He appears to have done the edit himself, the sparks are different in his image.

      • Marc W.

It looks like he did his edits based off the edits done in the tutorial (from the same website). But he’s still passing it off as his own.

  • U Really That Dumb?
    • Lindsay11

Ugh I hate videos, anyone wanna cliffs notes this for me and other people who can’t watch vids?

      • U Really That Dumb?

I REFUSE to watch it! I started and the dogs all went crazy!

        • Lindsay11

HAHA! OK I won’t contribute to the annoyance of your dogs. But you posted it!

      • Marc W.

I got into like 3 seconds, speech audio sucks.

      • peaceetc

Okay, I’m two minutes in, and he’s totes successful, people adore him, and despite his many struggles, he’s risen above them. Also, white people can’t dance (okay, he didn’t say that, but he he provided ample video evidence).

He really, really, really likes himself. I mean, like, really really.

        • Lindsay11

Thank you Celine! It’s good to have a healthy ego, sometimes people have just way too much. Sounds like his ego is on steroids.

          • peaceetc

Yes. So yes. The first several seconds of the video just shows his name. That about sums up the whole thing.

          • Lindsay11

Thanks for taking one for the team! I mean… cult.

        • peaceetc

I made it through the whole video! I deserve some sort of award for that, I believe. Also, white people still can’t dance.

          • U Really That Dumb?

            🙂

  • Chris Olmstead
    • Lindsay11

Huh. So… what? He just added some falling leaves? I can’t see too much difference between his and the og.

  • Lindsay11

“This photo was not planned it just happened.” (see attachment)

    • BullShite

So it just happened to be a stormy day in a produce field at the edge of the world, run by a woman of Asian decent who likes to model clothes and her new purse, and this dude was all like “Whoa, I’m goona take a picture, hold up a sec!”

      • Lindsay11

HAHAHA omg I just saw this. In a day of posts that have made me laugh really hard yours is one of the best!

  • U Really That Dumb?
    • Marc W.

Wait, can you be a CEO of a non incorporated business?

      • U Really That Dumb?

Only if you’re still in HS and under 18.

  • U Really That Dumb?

    • Lindsay11

Poor kid’s summer is about to be ruined! He should not have done this 🙁

      • U Really That Dumb?

        Yup!

        • Lindsay11

I admit I am having a bit of a hard time with this one. He is barely older than my oldest son. He could be my son, agewise! Then I remind myself that even my youngest child knows not to steal, so…

          ¯_(ツ)_/¯

          • U Really That Dumb?

            That’s cute!

          • Marc W.

Wonder if this is the product of the internet generation. “Everything is free on the internet”

          • BullShite

Honestly, if my kid was doing this, the next photo he put up would be one I took, of him holding up a sign that says “I’M SORRY I AM A LIAR AND A THIEF”

          • Lindsay11

hahaha sounds like you! If it were my son? He wouldn’t have a social media presence for quite some time.

          • U Really That Dumb?

Perhaps his parents are not yet aware of his little games.
OR, if they are, they don’t care. If the latter, I feel sorry for him! Doesn’t excuse it, but I feel sorry for him.

  • U Really That Dumb?

How long before GoFundMe pulls his page?
Reporting fraud is a pain, but if you’re persistent you can get through their games.

Don’t forget to report it to 500px as he’s selling stolen work!

  • Alex

Hello Everyone! It’s Alex! I’m going to take a minute to let the negative and sad comments keep coming! Then when we’re all ready to handle this like adults, I give my reasoning behind all this!

    • BullShite

      STOP!
There are no excuses we have NOT HEARD. Seriously. STOP, go back through the other postings, look up the “bingo card”. They are ALL the SAME. You KNOWINGLY took images YOU DID NOT TAKE, and claimed them as your own. There is no “reasoning”.

APOLOGIES….. not excuses is how adults work.

      • Alex

Once again! IF YOU CANNOT BE AN ADULT, Then DON’T EVEN BOTHER TO SAY ANYTHING TO ME!

        • Lindsay11

Well, I’ll give you that. We’ve never had a 17 year old try to lecture us before.

Anyways, take the time to read Jeremy Cowart’s link. See how an actual adult handles getting caught by Photo Stealers. http://stopstealingphotos.com/jeremy-cowart-los-angeles-ca/

        • U Really That Dumb?

The one that’s NOT an adult here is you. On multiple levels.
You do realize that even for a minor, fraud is illegal. At 17 you can be charged as an adult and could end up doing time.

        • BullShite

You mean “don’t bother saying anything to me if it’s not excusing my bad behavior, and the fact I lied to everyone I know on my facebook, including friends and family?”

Sorry no. In life, if you screw up, you will eventually be held accountable. You don’t like the consequences? Don’t lie, and don’t steal.

You have the chance to man-up, come clean, and stop this garbage. You want to be a photographer? LEARN FIRST.

        • Michael Goolsby

If this little dildo doesn’t stop saying “adult” in every post, I’m going to bitch slap him.

          • Hahah you’ve really gone off the deep end Michael.. weren’t you the guy a few months ago who always wrote nice eloquent reasoned responses to the dildos? 😉

    • Lindsay11

Alex, good on you for stopping by. I am certainly listening, please don’t give us lame excuses we’ve heard a million times before. Be honest. Thanks.

      • Alex

Hello Lindsay! Thanks for being mature about your response! A LOT of those images people know that I DID NOT take them! For example, the one of the guy from the MOVIE hangover! People know that I didn’t take that! Others images, I COULD NOT trace to the actual photographer! I really would have wished people would have been ADULTS and just asked why! I would be MORE THEN HAPPY to go BACK and mention the photographers names!

        • Marc W.

It’s not hard to trace who the owners are. Image.google.com makes it very easy. I did it in about 3-4 clicks.

Edit: Oh, plus you didn’t even 1) say this is not your photo originally, 2) even link to where you found the image. Therefore, you try to pass it of as your own.

        • U Really That Dumb?

Actually, selling the images is illegal, even if you do give credit.
And no, people don’t know. That’s why it’s called FRAUD.

        • Lindsay11

Alex, you’ve got to stop throwing the “adults” thing around. It really makes you sound very young. From what I can tell you are a mature young man and throwing “adults” around isn’t doing you any favors. Please take that as helpful advice and not some form of attack.

Next, so now you know it’s wrong, yes? What do you plan to do about it?

          • Alex

99.9% of the work on my page AND website is MINE! So it’s no big deal for me to delet a couple of photos! When I find the photographers of the images that are not mine, I’ll have a word with them to get their feedback of THEIR work

          • Lindsay11

Good, yes, you should do that. Make sure you also delete the ones that you have up for sale. You should also contact the photographers you stole from and apologize. You should also consider apologizing to friends, family and any clients.

          • BullShite

Manipulating a photo that you did NOT take, or that is NOT in public domain, or free use (which does not apply to all stock photos regardless of wether or not you paid for them) does NOT MAKE THEM YOURS.

          • U Really That Dumb?

Likely the ‘word’ you’ll be having is across the table in a court room when you’re loosing everything you and your parents have.

          • loltonelica

How can you possibly be so arrogant? Honestly. I want to know.

          • Lindsay11

He’s a 17 year old boy who is rarely told no? Just a guess.

          • U Really That Dumb?

            Yup!

          • BullShite

Or told by everyone he knew he had talent, and that, instead of leading him down the path to even HARDER work in perfecting his talents, and becoming someone ON HIS OWN, led to an inflated ego, and sense of entitlement. I hope this has changed that.

I long for the days when crafts people took on apprentices that showed talent. Not only because we need REAL talent in the Arts to survive through kids, but because these teachers would have booted the arrogance out of any apprentice.

I’m happy that my High School Art teacher kicked the arrogance right out of me early, and put my ass in place. I had her for ten years because she served both middle and High school. She’s on my facebook and STILL will KICK MY ASS if it’s not good enough, or if I used too much black because I was lazy, instead of a mix of dark blues and browns. 😉

I’d still be pretty mediocre and getting pats on the back from friends and family, wrapped up in my own bullshit if it wasn’t for her!

          • Lindsay11

Yep! Frankly, I wish someone had done that for me. It is a strange and sad day when the world comes up and slaps you in the face to wake you up!

          • U Really That Dumb?

Actually even one stolen image IS a big deal.
Please have your parents come here and we would be happy to explain it to them.

          • Lindsay11

I totally did not think of the fact that his parents will be liable for this. I bet Alex did not either! This is such an excellent point.

          • U Really That Dumb?

Under OK and Federal law they are liable AND he’s considered an adult at 17 for these crimes.
Assuming it’s just 9 stolen images, that’s $1,350,000 to start. Not likely that mommy and daddy have that much in savings. IF they do, I doubt they want to part with it.

          • Lindsay11

Good Glob! Another reason to keep a firm eye on your children’s social media. Protect them AND protect yourself! BRB checking kids’ facebook. :p

        • loltonelica

This does not make it ok. These photographer s don’t want credit for you editing their work. They will want money or you to delete them entirely. You have literally no right to those images.

          • Marc W.

“They will want money or you to delete them entirely. ”

            Or both.

        • Guest

this one on your FB page is not yours but you are promoting as if it is

          https://www.facebook.com/photo.php?fbid=10152309947292526&set=a.10150138764592526.336697.87899577525&type=1&relevant_count=1

simple google search shows this is the owner:

          http://500px.com/photo/62346915/dreaming-of-spring-by-lisa-holloway

and you removed her watermark! you need to remove what isnt yours pretty quick or open yourself up to some serious trouble.

          • Alex

WOW! This is SAD! Lisa Holloway was having a GIVEAWAY as it says in the picture! In order to enter you had to like AND share! PLEASE get your facts straight!

          • yep and i deleted my comment pretty much as soon as i posted it

          • and doesnt mean you havent taken images that are not your own 🙂

          • Lindsay11

In all fairness to Alex, it looks like he was entering her giveaway. He shared her photo (as she states one must do to enter), not uploaded it himself.

“How to enter in 3 quick steps:1. ‘Like’ LJHolloway Photography on Facebook.
            2. PUBLICLY SHARE this photo on your Facebook pages (personal AND business) to let people know about the giveaway. Shares MUST be ‘public’ to qualify!
            3. Once you have shared this giveaway on both your personal and business pages, leave a comment under this image with your name and email address as that will serve as your official entry (as well as my means of contacting you should you be one of the lucky winners).

            The fine print (please read):
            • This giveaway is not sponsored by Facebook.
            • Those within a 100 mile radius of Kingman, AZ are excluded from entering.
            • I reserve the right to remove entries that do not meet the qualifications.
            • SHARES MUST BE PUBLIC SHARES – NOT PRIVATE!!! YES, I will check! If you are drawn and do not have a public share, you will be disqualified. That goes for both personal and business pages!
            • Entries must be received by March 31st, 2014 at midnight PST.
            • Winners will be announced on Tuesday, April 1st. The winners will be determined by a random drawing.
            • Three seats in total will be given away – one in my class on Saturday, June 7th at 1pm PST, one in my class on Sunday, July 20th at 9am PST, and the final seat will be given away in my class on Friday, August 29th at 7pm PST.
            • Prizes are non-transferable – if you win and are unable to attend the class at the time you are drawn for, you will forfeit your prize – you may not sell it or give it away.
            • Your email address MUST be listed under THIS PHOTO for a chance to win. Email addresses left in other places will not be considered.

            GOOD LUCK!!!”

          • U Really That Dumb?

Considering Lisa is a fraud, seams only fitting that he would climb in to bed with her…

          • Lindsay11

Ooooooh really?? I’ve never heard of her, is it something that has come up before?

          • U Really That Dumb?

I’ll tell you later. But yes, she has BIG legal issues!

            She’s also CRAZY!

          • Lindsay11

OMG I can’t wait for story time. !!!

          • Keca

I’ll be checking for updates to this! I’ve had some nasty dealings with Lisa and her groupies…

          • Lindsay11

            Oh, do share!

          • Keca

Anytime anyone dares CC her photography, which admittedly is quite beautiful most of the time, she gets defensive and points her groupies to whichever post it is. They then have a pack mentality and attack the person critiquing, even as far as hate messages and name calling, and she goes right along with it. I’ve had a personal dealing directly with her as well. She is just very immature and thinks WAY too highly of herself. I’d love to know what legal issues she’s currently facing, it doesn’t surprise me at all.

          • U Really That Dumb?

That’s just the tip of the ice berg!
Federal and state along with interpersonal amongst members of the community and local businesses.
NONE of the local professionals like her and most won’t give her the time of day.

          • Lindsay11

Eesh the more I learn about her the more I want to back away like Disco Stu realizing Marge has kids!

          • yeh i posted then realised it was a link thats why i deleted comment 🙂

          • Lindsay11

I understand, I’ve made a mistake like that before and it’s super embarrassing haha… anyways, I don’t think you CAN delete comments here. It’s still here at any rate.

          • BullShite

I hate that deleted comments stay around stuff. I’ve had comments appear under comments that I didn’t mean to post under, or they have double posted, or I post them again because they don’t show up the first time, because Disqus sucks. 😛

          • ah ok – it isnt showing for me so I thought it had completely gone! too quick with the trigger finger when I noticed the text above linking to it!

          • Disqus doesn;t delete comments. In the future just edit the comment and remove the content.
            Disqus is stupid!

          • CrackerJacker

Though if he thinks Tulsa, OK is within a 100 mile radius of Kingman, AZ, he might want to stay in school a bit longer. (He’s off by about 1,000 miles).

          • Lindsay11

Also, I don’t see anywhere where he removed a watermark. If he did, that’s a huge nono. But let’s make sure we have our info correct before we throw it on the pile.

        • Lindsay11

Also, I know you don’t want to do this now, there are a lot of people talking to you and your adrenaline is going, but when you have a moment to sit and read, PLEASE go and read about Jeremy Cowart. Bookmark the link for later. I think you will learn a lot and it will be helpful to you moving forward. http://stopstealingphotos.com/jeremy-cowart-los-angeles-ca/

        • There is currently no “orphaned work” provision in US copyright law.

If you can’t find the photographer to get permission then YOU CAN’T USE THE IMAGE!

” I would be MORE THEN HAPPY to go BACK and mention the photographers names!”

Giving credit doesn’t mean you can use the images … you STILL NEED TO GET THEIR PERMISSION!

Look, just head over to photo attorney’s blog and read this article on the basics of photography law.

          http://www.photoattorney.com/wp-content/uploads/2013/02/Excuses-excuses.pdf

She is an actual lawyer who (along with her partners) specialises in copyright law and more specifically photographic copyright law.

Right now, your comments just aren’t helping you at all.

        • peaceetc

Alex, as others have said, it doesn’t matter if people know you didn’t create the images. It doesn’t matter if you couldn’t source the images. If you don’t have permission to use them, YOU DON’T USE THEM. The end. Learn about how copyright works, and what copyright infringement is. Giving credit is NOT enough. You must remove any images you do not have permission to use, in whole or part. Please, Alex, understand this because it is the law. What you have done is illegal, and you can be sued for a whole big bunch of money.

Again, giving credit is not enough. You must remove the images.

    • Marc W.

Your reasoning will be, I’m sure, that they are free photos that you were allowed to manipulate. Right?

      • Alex

Yes they were Marc! Thanks for the compliment! There are some images that were from the book “Compositing secrets” That I can Legally use!

        • U Really That Dumb?

But you can’t sell them. THAT is illegal. For proof see a number of the other people featured on PS. Oh, and the fact the 500px pulled all of them.

          • BullShite

Also, not saying “here is a photo from Compositing Secrets that I messed around in, what do you think” is lying by omission. If you are a “Photographer” people are going to expect that EVERYTHING you post is 100% yours.(Unless CLEARLY stated otherwise) You can’t sell a blue Volkswagen by posting a picture of a silver Honda, just because both are CARS.

Even in IF you had permission to use these images AND sell them, you are STILL being dishonest in letting people think that they are yours, by default of the fact you are presenting yourself as a photographer.

          • U Really That Dumb?

            What year VW? I’m assuming you’re talking about a Beetle… 🙂

          • BullShite

Old school Beetle, not one of the new ones that you can’t even take the doors off of. LOL!

          • U Really That Dumb?

            I’ll take it!

          • Marc W.

But only if it looks like a Silver Honda.

          • U Really That Dumb?

Seriously? WHY would I want my Old School Beetle looking like a silver Honda? Besides, I have a red Honda. I’ll sell that to you @disqus_Rz5d9Fd3Mj:disqus and then buy the Beetle!
Better yet, buy the Beetle and drop the V6 Honda motor in!

          • BullShite

            OOOOH hell yeah!

        • Lindsay11

Alex, I really do hope you see the issue here. I hope you have learned from this. I hope you will continue to grow and learn and add something to the photography world. Marc was right, no need to steal. Make this right, don’t ever ever ever do it again and I really do wish for good things for you.

You will grow out of the attitude eventually. That will also help you, a lot.

        • Walter Addeson

The license for these images clearly forbids commercial use, and use on websites:

“Just a quick reminder: These downloadable, high-resolution photos—from iStockphoto, Fotolia, myself, and my friends and made available to you here—are licensed for your personal use only in practicing the techniques shown in the book. They are not licensed for use in any other manner, including commercial projects, websites, or any other use. Thanks for honoring our copyrights.”

Here is the relevant page: http://kelbyone.com/books/compositing/

    • peaceetc

If you’re really Alex — take down the images which are not yours (either in whole or in part). That’s all we want. You can go about your life after you’ve done that, and we’ll move on with ours. No excuses are needed, just don’t use others’ images without permission. That’s all.

      • BullShite

AND DO NOT DO IT AGAIN!

      • Marc W.

And I’d like to add that Alex’s own images are pretty damn good. No need to steal others to manipulate.

        • BullShite

That’s why it’s a crying shame he turned thief. Given a few years, some heavy practice, and some schooling, he could have done pretty well on his own, with his own work, and probably at a pretty young age. I do NOT get why people who just need some more practice and time jump the gun.

I’m in my 30’s and even I still feel that my talents are always needing refining, and that I can always use more education, because the point is to be as perfect ON YOUR OWN as possible, as best as possible, and never stop pushing past what you were yesterday until the day you die.

Taking someone else’s image is just a cop-out. I couldn’t imagine putting tracing paper over someone else’s work, copying it with a few modifications, and sitting back and saying “I MADE THIS” with any real sense of pride or accomplishment. I just do NOT GET IT.

          • Lindsay11

LOL well that’s because you are an artist. I’d be thrilled if something I traced looked anything like the original. This is probably why people who steal do this. They can’t produce the original!

          • BullShite

Just don’t say “I can’t even draw a stick figure” because frankly, neither can I! HA!

          • Lindsay11

Nooooo my (stolen) line is “I can’t even draw a straight line with a ruler!” Sadly, that is true. Why won’t the ruler sit still!?

          • U Really That Dumb?

            Mine: 🙂 😉

    • “I give my reasoning behind all this!”

No reasoning you can give can change the fact that you violated several photographers copyrights.

No reasoning you can give will change the fact that you are falsely representing these images as your own work.

      Ask Chris Jones about composites.

    • Justin Case

      Hey Alex.

Like you say in your video, ‘although you can not go back and make a new start, you can start from now.’ I totally agree.

First, let me say that I can imagine that this is all pretty intense and shocking how big a deal this became so quickly. It has been slow here on this site lately and a lot of people are watching and waiting to comment. Your bad luck that it happened to be you that was discovered at a slow time of year.

Now some advice. I mean this sincerely, and not just to beat you down or talk down to you because of your age. Beginning photography these days can be very exciting and surprising how quickly you can achieve good results. I totally get that you found something you enjoy and do well and you want to show the world you skills. That’s what blogs, facebook, flickr, myspace, or whatever are for.

When you open a business it’s a different matter. And not just legally. When you take money for your work – or even just ask for money for your services – you are by definition a professional. Your advertising – and that is what your website, facebook business page, etc ARE, advertising – must be honest, open and legal.

I imagine that you feel like what you have done is being misunderstood and is a victimless crime since you are not taking anything directly from other photographers but just using their work to create something new. (This is illegal, but I will let others explain that to you.) For me, the bigger problem is that you have not been open about what you have done, and you have even posted (c) and ‘all rights reserved’ on your page showing that YOU claim moral authority to the works. This implies that everything posted on your page is yours, and now that I know that some of it is not, I don’t trust any of it.

And that is really the bigger problem, and why this site exists for me. When you take shortcuts and carefully imply that work that you didn’t create is yours, it makes me distrust EVERY image, and this hurts everyone in the photo industry, not just those who didn’t get credit.

Start from now. A sincere, open apology goes a long way. An honest statement on your website and facebook page explaining your working methods and process so that no one is deceived also seems like a good idea. Then do your homework: learn about copyright from a lawyer or in a class, not just on the internet.

It can be very tempting to start a business when it seems like everyone else is doing it these days. But anyone who runs a real photography business will tell you it is much more than just having an expensive camera and some photoshop skills. It is a business, and if you don’t have experience as a business person, you are opening yourself up to a VERY expensive learning process.

Enjoy your photography. Keep learning, study with some experts and good luck to you. You have a lot ahead of you.

    • Photo Stealers

Alex, you’ve been caught before and instead of cleaning up your act and moving forward with your own work which IS decent, you continued to steal and use images that were not your own or that you had legal rights to use. Take that camera you claim to have got last year and make your OWN images to composite with.

      • Lindsay11

WOW I wish I had known he was a repeat offender a few hours ago. I would have taken a different tone with him I think.

        • Justin Case

I agree. But that’s why it helps to have a ‘comments’ section, the more information, the better informed the discussion can be.

  • U Really That Dumb?

    Hey Alex…
Have you looked at your 500px page?
FYI: They are NOT NOT NOT happy with you right now! So apparently you DID do something illegal or they wouldn’t have pulled them.

    • Lindsay11

Damn, that was amazingly fast! Are you a wizard??

      • U Really That Dumb?

        Yup!

But notice we’re getting crickets from Alex now. He’s PISSED that they got pulled! Pissed about the fact that he’s been caught! Pissed that he likely has to explain to mom and dad WHY they are getting served court papers and a certified letter from GoFundMe and 500px!

        • Lindsay11

Good point, he disappeared the same time his page did.

        • BullShite

I hope he learns from this and takes it down a notch. With a little humility and time he could probably be a pro early on.

I don’t know why people can’t just be happy being hobbyists or letting people know they are still refining their skills. There is no shame in that. It’s all a learning process…. but no, everyone has to put up their unregistered “business” and act like big shots… then this shit happens.

At least this is happening to him NOW and not ten years down the line. The owners of the photos might balk a little at suing a kid (maybe) but not a real adult.

  • Lindsay11

See, this right here is part of the problem, Alex. You are trying to pass off photos as “natural” when they’ve obviously been through photoshop. If you want to say no lens flare added whatever, that’s fine! But these are not straight from the camera photos either. Can you see how this is misleading? Trees don’t have halos. At least, they don’t in California.

    • i think as a photographer the important thing is to get your basics correct and composition and subject matter are a big deal. I thought the same as Lindsay about your “natural” shots – they have been heavily and clumsily overprocessed and the halos are pretty nasty. Your portraits (those that are your own) are not bad but you need to take time working on the basics first so you can use your own backgrounds for your composites.

      • Lindsay11

I’d like to add, I’m not a photographer or an artist. I had to ask Helena if one of his other photos was a composite LOL So the fact that even *I* can tell these are photoshopped says something, eh?

        • i am not a professional. have been hooked and out at every opportunity taking photos over the last 4 years or so. Finally getting happy with my shots now. I used to do the horrendous halo HDR landscapes – nasty stuff! Always something new to learn but have improved so much over the years 🙂

It’s amazing to me to see someone so young as Alex asking for funding and being so arrogant to people about what’s he done. Surely it’s all about learning your craft and enjoying the journey and seeing yourself progress. Not about a quick fix of getting others to give you money so you can buy gear. He obviously has a camera so needs to work on improving his skills using his own photos. He has time on his side 🙂

          • BullShite

Also, he’s 17…. you want camera equipment? GET A GODDAMNED JOB!

          • yup! that was my exact thought when I saw the GoFundMe site!

          • Man … iwsh I could have crowd funded my several cameras, lighti ng, gear, computer, memory cards … maybe Ill start a crowdfunding campaign to pay for my business operating costs.

            *rolls eyes*

          • Lindsay11

While he could be lying, he does say he had a job before at Walgreens when he was 15.* If it’s true he’s taking college classes in addition to high school work, I can see where it would be hard to have a job as well.

*I got to thinking about this and who knows? My son is 15 and he is having a hard time finding a job because he can only work so many hours and there is a lot more paperwork for the company. So does Walgreens hire 15 year olds? Who knows? But maybe I should tell my son to apply there. :p

      • BullShite

Or start a “business” or “company” and try to be a professional….

    • Extreme HDR is not natural.

  • U Really That Dumb?

    Oops!
    Can you say Adios?

    • U Really That Dumb?

I guess they WERE serious when they told him to stop…
Shows prior knowledge that his acts were illegal.

    • U Really That Dumb?

@Alex:disqus, why no comment on this? Have you received the C&D yet? No? Wait for it!

  • peaceetc

Alex, I’ve responded to you below, but I want to clearly state a few things which I believe have you confused.

    1. All images are inherently copyrighted the moment the shutter is pressed by the photographer. Unless an image is specifically placed into the public domain or is licensed under a Creative Commons license, you MUST assume it is copyrighted. That means you can’t copy it, modify it, or otherwise do anything other than view it without express permission from the photographer *before* you use it.

    2. Giving credit is not enough. Let me repeat that — giving credit is not enough. You need permission.

    3. Copyright infringement is illegal. You can be sued for thousands of dollars for each copyright violation. That is the law.

    4. We don’t care about your reasons or excuses. They simply don’t matter. If you violate the law and cheat other photographers by stealing their work, you need to answer for it. Remove all the images, contact the photographers from whom you stole, tell them and apologize for what you did, and hope they don’t sue you. And above all, DON’T DO IT AGAIN (hat tip to BullShite for that reminder).

    5. You don’t get to come in here and tell us how to treat you. Check your attitude, because you will not win. Right now, the only thing you should be doing is trying to fix what you’ve done.

    6. Lastly, take this seriously, and for goodness sake, learn some humility. I get the distinct impression you are rather fond of yourself and your skills, and trust me, that ego will get you nowhere. You, my friend, are not a special snowflake.

You seem to have talent, Alex. Don’t f*** it up by cheating and stealing. Do it right, and you could actually make something out of yourself. Screw up, and people will find out and you will have to deal with the consequences.

    • Photo Stealers

The problem is he didn’t even give credit…

      • peaceetc

I know. But he said somewhere below that he would give credit if he knew who they were, so he seems to think that’s enough. Obviously, it isn’t.

    • Metal God

“Screw up, and people will find out and you will have to deal with the consequences.”

Yes, Doug Gordon knows all about that…

  • Marc W.

I think this is his twitter post.

    • U Really That Dumb?

      Possibly but not certain.

  • Kira Silvers

Facebook and all stolen images are still up…but he banned me from posting anymore…

    • Churva

      Me too!

      • Alex

Yes I did and if anyone else leaves a negative comment, I’ll be sure to BAN them to!

        • U Really That Dumb?

Good for you! Keep it up as I’m SURE God and your parents are SO proud of you!

        • Churva

Because you’re stupid shit. A thief will always be a thief!

  • Alex

Okay everybody I’m back! You people must not really have a life! You’ve been on here for how many hours? But anyway Keep the negative comments coming!

    • Lindsay11

Nah we’ve seen that one done recently. Try another one, son. http://stopstealingphotos.com/kimberly-mallett-photography/#comment-1477028040

      • Alex

Wow look at you Lindsay! And your a mother, right?

        • peaceetc

No. Don’t go there, Alex. Just don’t.

        • Lindsay11

So you want to speak to professional photographers, ones who could possibly help you and possible clients who might hire you, with such a shitty tone?

          • Alex

For the people who told me what was right and then LEFT IT ALONE! I’ll listen to them! You’ve been on here for HOW MANY HOURS! A person can only take so much!

          • Lindsay11

Actually, I’ve been gone for awhile, I just sat back down and saw that our darling kid was posting again.

Why haven’t you removed the stolen photos, child?

          • Alex

I’ve reached my limit and im about to take this to a WHOLE other level! If you and Helena want me too! We can GO THERE!

          • Lindsay11

LOL sweetie, the only place you need to go is to your room. WTH are you rambling about?

          • Alex

You know what, Justin is right! It is about me fixing what I’ve done! Sorry Lindsay, I shouldn’t have even tried to go to your level! But if you want to bash me go right ahead!

          • Lindsay11

No one is bashing you darling. Just highly amused at your antics. See, I was being very kind and patient with you this morning. Then you came back with the teenage attitude you’re so good at. Then I learned you didn’t just make a mistake and this isn’t the first time you’ve shown yourself to be a thief. So I don’t have quite as much patience with you any longer. You’ve done something wrong. You’ve done nothing to fix it and have most likely made it worse by bringing your ridiculous attitude out here.

And yes, this is very much about you. So again I’ll ask you, what are you going to do to fix it?

(Keep playing games if you want, this site and your name will be flying to the top of google search. Won’t that be nice? Your friends will be able to see what a thief you are with a simple google search for Alex Burkhalter)

          • Alex

Anything else you feel you have to say Lindsay?

          • Churva

A thief will always be a thief.

          • Lindsay11

Not at the moment but something will come to me.

Oh yeah, lay off the photoshop a little maybe. I like a lot of your work but you rely on ps way way too much.

          • Alex

Yeah your right, I do! Anything else?

          • Lindsay11

Yes, why are you still here posting dumb things instead of “acting like an adult” and fixing what you can while you still can?

And still, it’s you’re. You are is you’re.

          • Justin Case

Alex, please don’t. This is about you and how to fix what you’ve done, don’t make it about others.

          • peaceetc

No threats, Alex, unless you want to be banned from commenting.

          • Alex

If you feel you need to banned me, go right ahead!

          • U Really That Dumb?

Actually it’s funny watching him hang himself here. He has NO idea the power behind PS.
Alex, look at some of the BIG BIG names that have fallen because of PS.

          • peaceetc

No, Alex, what I want is for you actually read and understand what we are trying to tell you. We can help you do things right, if you would let us. Please, stop being so defensive and actually use this as a means to learn and grow.

          • Helena

Pardon me? What whole other level is this? What are you trying to imply here?

          • Lindsay11

He likes middle aged moms OR he likes pregnant women. Or he wanted to punch us LOL It’s pretty funny, really. I don’t think I’ve laughed so hard at a stealer in awhile!

          • Marc W.
          • Helena

You are on FIRE today. :’)

          • Marc W.

I’m speaking in stolen photos. You know, because it was free on the internet.

          • Helena

            Hahaha. 😀

          • CrackerJacker

He talks a lot on his site about the importance of religion in his life, yet he does not back that up with his actions. Actions speak louder than words, Alex.

          • Lindsay11

HAHAHA I think he is threatening me with a street fight? Very Christian!

          • Alex

People like you make me laugh! So I cai’t have a breaking point because I believe in God!

          • Lindsay11

No, you can’t threaten people, lie, steal etc etc because it makes baby Jesus cry. Or maybe you are missing parts of your Bible?

          • CrackerJacker

I’m not talking about your breaking point. I’m talking about your actions. I believe you may not have realized that what you were doing was wrong. As Justin Case pointed out below, once you tout yourself as a professional with a business, you are held up to a more rigorous standard. But now that you know, if you are a godly person, you need to get right. Being defensive and arrogant is not godly behavior — especially when it is in service of doing the wrong thing.

Just take a couple breaths and think about that.

          • Lindsay11

Corey Ann points out below that this is not the first time he has been caught stealing. He definitely knows this is wrong.

          • peaceetc

Yep. I left, went to the dentist, came home, fed the cats, did some editing, etc. We aren’t just sitting here staring at this page.

          • Lindsay11

To be fair, sometimes I do. Just, not this morning. LOL

          • peaceetc

Have you removed the images you don’t have permission to post (and again, credit is NOT enough — you need permission from the photographers themselves) from all your social media and web pages? Last I checked, you hadn’t. How about you do that, and let us worry about what we do with our time?

Seriously, Alex. If you want us to act like adults, then you need to do the same.

          • doncalifornia

People would not keep on about this if you removed all the photos immediately and then seemed even the slightest bit contrite. But you’re dismissing everything that is being said. The more I read your comments on this thread, Alex, the more I come to believe you have a very rough future ahead of you. You’re acting like a 9-yr-old.

        • Helena

          *You’re.
          Don’t start sentences with and.
Concentrate on school because you obviously need it more than you do a fraudulent photography business.

          • Lindsay11

A comma after “wow” too, I’d think.

          • Lindsay11

Since he types so slow, I thought I’d ask you OT sorry, are you getting my facebook messages Helena? I don’t think they are going through and I rebooted my computer and everything!

    • peaceetc

Why don’t you try turning off the attitude actually reading what we have to say? You might actually learn some things. We are well versed in this stuff, and a lot of us are established photographers. You’re shooting yourself in the foot if you don’t take this as a learning experience.

    • Churva

      Please somebody sue this person!

    • Helena

I’m on maternity leave from my paid job, which I have in addition to running a household and looking after a 3 year old. I’m an actual, real life adult, which is the word you seem to be saying a lot on here. I have real life responsibilities. I also have time at present.

I get it, you’re 17, and you think you’re God’s gift to the world. Most kids do, but please be assured, you’re not. You need to take a step back and listen to what people are telling you. Drop the attitude. Take down the work that is not 100% yours. Learn some humility and stop blowing smoke up your own arse, before someone hands your arse to you with multiple law suits. People here will help you if you stop behaving like a spoiled brat.

I’m not going to tell you to grow up, because you’re 17. You are still a kid. What I will say is you are not ready to be a professional photographer. Not with this attitude, and not with this lack of respect for others in the industry. You need to concentrate on school first and foremost, and only then learn the craft. Then learn how to conduct yourself in business, because this is not the way to do it.

    • It’s hard to put a positive spin on what you did. What you did was wrong and your attitude isn’t helping any.

Instead of taking this as an attack take it as a learning experience. You obviously have no clue about the laws that are involved in the industry you’ve decided to start in … read what we’ve posted. follow the links we’ve given you. LEARN FROM THIS.

You REALLY need to read up on copyright law before you end up getting sued by one of the photographers who’s images you used.

Just to give you an idea, they can sue you for statutory damages of 150,000$ US per image you used without permission. If you removed any watermarks then they can add in another 2500$ to 25000$ for violating the DMCA’s provision on circumvention of rights management information.

Head over to photo atorney and read her primers on copyright. It’s well worth the read.

      http://www.photoattorney.com/

    • U Really That Dumb?

      Alex,
While you may think we are all tools sitting around at a circle jerk, you may want to think again. If nothing else we got your 500px account shut down AND a number of other things that you are not yet privy to.

As mentioned below, you claim to be a follower of Christ. WWJD right now?

As for your threats about taking it to the next level. Remember that everything you say IS admissible in a court of law AND of public record for your entire life and career. Every job you apply for, every school you try to get in, all of it WILL follow you! This will not get deleted no matter how hard you try. Others have and have failed miserably!

So before you continue down this road, you may want to think about what all you have at stake, including your freedom, friends, and family.

      • Alex

Actually, you didn’t get anything SHUT DOWN! I emailed 500px and I know what going on!

        • Lindsay11

Well good, now how about taking down the rest of the things you stole?

        • doncalifornia

          And how about your GoFundMe?

          • U Really That Dumb?

            Yeh well… There is that!

    • doncalifornia

Honestly, Alex? You’re daring this site to keep after you? LOL. OK, next year about this time let’s all look back on this week and see how well it’s turned out for you, OK? My bet is on “not well”

  • Justin Case

Alex, again, I hope you can start over and fix this.

    1. remove the images that you didn’t take. Even if they are composites, unless you have written permission from the creator or authorizing agent to use them for your specific purposes, you can be liable.
    2. Be open and honest about your work. If you feel any of your labeling or writing could be misleading or misunderstood, rewrite it.
    3. Get out of the negative place. Fighting with people here will not do anyone any good, and I assure you, many here have had plenty of experience.

IF YOU DON’T start to fix this, the next thing to happen is your IP
provider will start receiving DMCA takedown notices and you will soon
find yourself without a website. Facebook will likely soon follow.

Next, someone will get upset enough that they will start sending you invoices
for the use of their images. Ignore those, and you might start
receiving letters from lawyers that will be much harder to ignore.

    • U Really That Dumb?

Zenfolio is NOT happy either! Yes, they are following this and taking appropriate steps.

      • U Really That Dumb?

Oh, they did say that the more people report it, the better…

    • Alex, you are probably thinking no one will ever sue you right? think again.

some photographers make more by suing infringers now than they do from actual shoots.

when you consider that, in the US, a single infraction can net a photographer 150000$ in statutory damages … it’s not hard to believe.

sure, most people end up settling out of court but normally you are still looking at anywhere from 300$ to several thousand dollars per image plus legal fees.

Here is an article about a UK photographer.

How I paid off my mortgage by chasing copyright thieves
      http://media.gn.apc.org/fl/1406scc.html?i=c-list&d=2014_06

      • BullShite

Not to mention, if your are a photographer who’s work was stolen and posted on StopStealingPhotos….. all the PROOF has been collected for the case already.

Between the screen-caps, the text conversations, and oddly enough, how Disqus doesn’t really remove “deleted” things….. well if you were sued it would be, unfortunately for you, and open and shut case. Or unfortunately for your parents, who MIGHT be the one’s paying the bill depending on how much of an adult the judge thinks you are.

  • Kim Johnson

Hello everyone! It is sad to see a lot of adults attack a 17 year old! Alex was not meaning any harm to anyone’s images! He simply practices his editing skills and shows his family and friends! Please just let it go. Thanks

    • Alex

      Thanks Kim!

      • Churva

        Oh hi alex.

      • Lindsay11

HAHA wait, did he even forget to change his screen name before he posted!!? What DO they teach in schools these days?

    • Lindsay11

No one is attacking him. We are trying to help him. What he did was wrong and it was illegal and we are trying to get him to fix this. We are trying to get him to “act like an adult”.

” I didn’t mean to run over your cat ma’am, no big deal because I didn’t MEAN to.” Doesn’t really work, does it?

    • Justin Case

Well Kim, if that were true then we wouldn’t be in this mess. Unfortunately, Alex was running a business, as is quite clear on his BUSINESS website. Other rules apply.

    • Churva

No one is attacking him! Everyone are giving advices to him but still he acts arrogant!

    • “He simply practices his editing skills and shows his family and friends!”

No he wasn’t. He was using other people images to try and start up a business. Your disregard for other peoples rights is appalling.

      • BullShite

I think he was even SELLING stolen images too, so there is that…

        • Lindsay11

          He was. See attached.

    • U Really That Dumb?

      Hi Alex!

      • Helena

Same IP? Wow, you’d think a young’un would know better.

        • Lindsay11

          How embarrassing for him! LOL

        • U Really That Dumb?

          Right!

        • Marc W.

Why, most young’uns don’t care how things work, just that they get their snapchat and mp3s.

          Get off my lawn.

          • Helena

I mowed mine today, because I am a responsible adult. *pats self on back*

      • Might not be Alex, could be someone else in his house, school, place of work, cyber café … but yeah … not looking too good.

I wish these things would also show mac addresses so we could tell if it was from the same device.

      • Lindsay11

Hey, interesting that alex7world email leads to a removed Flickr album. http://www.flickr.com/photos/103140912@N02/9937360715/ So I’m guessing that was involved in the last time he got caught yeah?

    • Helena

He should know better than to imply threats towards women at the age of 17.

    • I have a cyber pitchfork specifically designed attack photostealers. 🙂

    • doncalifornia

Posting photos to websites and social media, in the forms of a photography company and graphic artist, is not just showing family and friends. Selling said photos is a business. And it’s fraud.

  • Kim Johnson

But come on guys! His photography company is not even big yet! He’s just seeing if this is what he wants to do for the rest of his life! From my understanding, someone woke up this morning, found his photography page and decided to say hurtful things! And if someone’s trying to help another person, you say what you need to say and then leave it alone! You just keep going, going, and going

    • U Really That Dumb?

That has ZERO to do with it! He was warned many times before and told the people to fuck off.

      • Kim Johnson

I give up! I will go tell Alex to take down anything that is not his!

        • Justin Case

thank you. Now I think you are starting to get it.

        • U Really That Dumb?

And to close down both his FB page and Zenfolio. Why? Because it
“may” help him with the prosecutor and judge.
Yes, that is NOT a joke!

        • U Really That Dumb?

Don’t forget the GoFundMe page. Which I see has comments. I’m sure they will grow now that people know the truth.
          http://www.gofundme.com/9p4ufw

    • Lindsay11

Alex, you really need to stop LOL

Go delete those images while you still can before you get sued. Really.

    • CrackerJacker

      You understand incorrectly.

    • Lindsay11

LOL yes, someone just woke up and decided to say hurtful things. Are you even listening to yourself?

    • U Really That Dumb?

What part of FRAUD with prior warning did you NOT understand? It is ILLEGAL in every state and country!

    • UMMM HMMM
I going to start selling cars. Since I am just starting I will go over to the nearest car dealership and “steal” their cars. Then get the money put in my pocket because I did all the work.
You know because I want to see if I want to do this for the rest of my life … so a little stealing does not matter … right?

    • How does that change the act of copyright infringement?

  • Lindsay11

Doesn’t this sound like all our thieves? From his gofund me page: “I created my own website but then I realized that I needed professional potographs on their.”

    LOL

  • V323

Ahhh the joyous life of being 17. Old enough to think you have it all figured out, too young to have realized yet you know nothing.
Alex, you stole images. The reasons, intentions, do not matter. What you do from here will reveal your true character.

  • Kim Johnson

He took every photo down that was not his! Please leave him alone. One minute you guys are bashing him, and then the next, you are bashing me saying that I’m Lying about who I am. Well I hope everyone has enjoyed this bashing session!

  • Lindsay11

Hey little buddy, Corey Ann posted this only 5 hours ago and Photo Stealers is already third in a google search of your business name. *see attached* Wouldn’t the smart thing to do probably be to wise up and make this right before it’s number one? How about when someone searches Alex Burkhalter? That right there is embarrassing and bad for business. Let’s do the right thing before you dig yourself in deeper. That means no more made up accounts, no more threats. That means removing any photograph that you didn’t hit the shutter on or don’t have permission to use. Even that tree one you claim is yours. That means apologizing to the photographers you stole from and your friends and family and future clients. That means, most importantly DO NOT STEAL AGAIN. You are posted here and we like to keep an eye on thieves. You do it again and we will find out. Truth.

    • hell we check out stealers all know as far back as 2012 smh

    • Just a Girl

Not to mention this is a 17 year old with a huge future ahead of him. Employers now a days head for the Internet to do all kinds of background searches. This cant bode well for him AT ALL!

  • Infosecbert

    Hi Alex,

I don’t often post on here, but I do read the deep tome of information here.

One aspect of your actions is a repercussion you should be very concerned about. Many posters have pointed out that this may limit your ability to be a professional photographer, but it’s a much larger issue for you.

Most employers these days search out information on potential hires. Not only might your acts of alleged and apparent intellectual property theft keep you from being hire-able as a photographer, but you may limit ANY employer from wanting to take you on. For someone who has photography as a hobby, and a reputation based job as a career- you need to know this may severely limit your ability to get any job. Even if you’re otherwise an ideal candidate. The job market you’re getting into for the first time is oversaturated. There are people with a college education, 10 years experience on you, and children at home who can’t find work. You do not need to handicap yourself with “potential criminal”.

If you care about your future, take into consideration that you’re limiting your self from entry into higher earning jobs where trust is essential; financial services, accounting, any government job, that includes working at a college in many cases, stuff you wouldn’t think of at first.

Don’t take this lightly, don’t shun and insult the advice these folks are putting in your face. You may not like it, but the actions are yours, they are holding up mirrors and telling you what effect your actions have.

    • Lindsay11

You should delurk more often. This is an excellent post with an excellent point.

      • Marc W.

Delurk. Is that a word? If not, it is now.

        • BullShite

Investigoogle, delurk….. how to spell you’re…. my vocabulary increases!

          • U Really That Dumb?

            Don’t forget LQQK

          • BullShite

            ERMAGHERD yes!

          • Amber Kost

            Ermagherd, its a yernicurn!

        • Lindsay11

Oh I dunno, I thought it was! I guess it is now.

    • BullShite

IF YOU BELIEVE IN GOD……..HOW IS THIS NOT HIS MESSAGE TO YOU ALEX??

Do you NOT think that the hand of God would work though other people?
HE gave you your talent that you are NOT exercising with the theft of others, and likewise stealing, which is against his word. How can you NOT see that this is the very God you claim to believe in, working to both punish what you did wrong and force you to use only the talents HE gave you, not the crutch of other people’s work? Ask you pastor what s/he thinks.

LOOK AT THIS FOR WHAT IT IS. How can you NOT see God in this?

  • U Really That Dumb?

It looks like Alex is having a No Good, Very Bad day…

    • peaceetc

I’d like to think this will be enough for Alex to get the point. Am I deluding myself, Alex, or are learning anything at all?

    • Justin Case

could it be that ‘Kim’ actually got through to ‘Alex’ and convinced him to start taking things down?

    • Lindsay11

I just got home from lunch. I was hoping that while I was gone he would have removed the photos. No such luck. At least go fund me is down! Celine, I hope this will be enough as well, but who knows. I’m not going to hold my breath, are you?

      • peaceetc

Sorry, Lindsay, but I died from lack of oxygen and can’t respond.

        • Just a Girl

          hehehe

  • Guest

As I’ve been reading through this particular bit of thievery, I noticed that at least one other photo is still listed on his website as his own (watermark and all) but is an image from a PhotoShop tutorial.

Or did I miss it somewhere in the comments already? If I someone else posted it and I missed it, my apologies.

    This: http://www.psdbox.com/tutorials/professional-widow-manipulationtutorial

It’s also listed here, on his site, as one of his “Portraits”:
    http://kingdom7unitedimages.com/p599687722/h2e8a4d43#h2e8a4d43

    • U Really That Dumb?

      Yup, stolen…

    • Amber Kost

Haha I watched that same tutorial two years ago. How do people not put two and two together?

    • Photo Stealers

The source image is from Deviant Art (linked above – as well as the tutorial) but his image is his own edit I believe done with that tutorial – the flame sparks are different. Still definitely not his own original work though.

      • Justin Case

He seems to have removed that image from his website, but there are still images that he edited that he did not take.

Glad you didn’t give in to the pressure to remove this due to his age. He still doesn’t seem to get the problem with what he’s done.

      • GlennMcQuaig

Well, yeah, and the fact that he has slapped his own watermark on such a widely distributed image leaves me baffled.

    • GlennMcQuaig

Oh, man. How did this end up being posted as “Guest”? This is from me. I signed in, posted it, then realized it had already actually been covered in the opening photos. So I thought I deleted the post. Weird.

Instead of being deleted, it just reverted to being put here anonymously. Oh well. So much for my skills at posting properly! Lol!

Anyway, this was mentioned, and I did miss that part when I read through the thread.

  • Hmmm

Another one of those cases where you wonder if the PPA knows he’s using their name.

    • U Really That Dumb?

Perhaps someone should notify them. Perhaps multiple someones…
That would be the right thing to do!

      • tony

You are a asshole! How about you get a life and go take care of some kids or something you jackass!

        • BullShite

Better to be an honest asshole, than a dishonest thief, hiding behind their supposed love of God.

          • U Really That Dumb?

I’m also a JackAss! Please don’t forget that.

Should I get a new tat that says: Known Photo Thief Alex says I’m a Jack-Hole!

          • Bill

wow you ppl r pathetic! I CAINT EVEN WASTE MY TIME w/ you dumbasses! u do anything to continue to bash a 17 year old boy! newsflash u a grown man!

          • I can’t believe you took the time to create new email addresses when you could have spent that time clearing up your mess and putting things right. You just look really foolish and childish now Alex. Shame you can’t see how this could affect your future but I guess you just can’t tell teenagers. Thank god my stepson who is also 17 acts a lot more mature than this.

          • Lindsay11

Jesus would totally make up fake names and lie online. Keep doing you, Alex!

          • BullShite

Actually if Alex went to court over copyright infringement, he would be considered a “man” more likely than not. A 17 year old is old enough to know right from wrong. If my kid ever behaved like this….. let alone wrote like this….. I would be ashamed.

I can’t imagine you were raised to steal and talk like this.

          • Helena

Yet Alex was the one yesterday telling people they were being immature and threatening. Go home child.

        • Lindsay11

hahaha is that the best you can do?

        • U Really That Dumb?

          Hi Alex,
I see you woke up in a bad mood this morning. Didn’t sleep well? Upset you got caught and that your piss poor attitude yesterday cost you?
Please let Kim know that we are still waiting on her evidence.

          • tony

This has nothing to do with Alex! We aint talkin bout alex we talkin bout you jackass

          • U Really That Dumb?

Alex, you’re young and desperate. You’re also stupid.

          • Bill

No i’m with tony YOU R A JACKASS

          • tony

We r on tha same page Bill!

          • Lindsay11

            LOL theman!

          • U Really That Dumb?

Why don’t you ask Alex what this tone cost him yesterday… See if he wants life to continue like that… Because the people in this group have the connections in the industry to make sure he looses everything.

          • Lindsay11

Alex, don’t be stupid. Stop playing baby games. Are you a baby? No you are not! How about removing those photos big guy?

    • Justin Case

I believe the PPA reference has been removed. Regardless, he isn’t listed as a member.

      • U Really That Dumb?

        Alex,
What you’re not understanding is we HAVE been around the block and we have seen it all. Your lies are transparent to us. You’re continuing to attack and deny will only end up costing you.
It may be a joke to you now, but some day there will be a college or job that looks you up and they are going to see this. Had you done the right thing and apologized right away, they may say yeh, just a young kid. But now, not so much.
Take a long hard look at your future, as you said in your video, and make changes NOW! This isn’t going to be a book you can erase. It’s part of the story of your life that will haunt you forever if you don’t stop your shit and grow up now.

  • MPR1776

Woot…Woot, finally got one in my neck of the woods! He’s not a member of the Tulsa Photogs Meetup Group.

    • Lindsay11

Well now you know what you have to do… spread the news to your fellow locals!

    • U Really That Dumb?

Perhaps the local news wants to know. How about Chandler HS? Know anyone there?

  • Bill

Alex to me about you pathetic people! I didn’t believe him at first but I guess its true! 30-40 year olds with NO LIFE!

    • Lindsay11

Do you even know what an IP address is youngling?

    • U Really That Dumb?

How about addressing the fact that he is a thief and a fraud?

  • U Really That Dumb?

Alex, please stop your bull shit game. It’s getting old. At some point you’re IP is going to get blocked.

    • Lindsay11

It might be the best thing we could do for this young man: save him from himself, maybe?

    • Bill

Its funny how u think you know about networks! we are all on the SAME wifi network asshole! leave alex out of this. he has nothing 2 do w/ this. once again I prove my point! u guys are assholes and will do anything to TRY 2 bring a 17 year old boy down! get a LIFE! good day

      • Helena

So Alex got a group of his friends to jump to his defense? Jeez, that’s even more moronic. How is that helping the situation at all?!

      • U Really That Dumb?

Good luck with that thought process.
You coming here as Alex or Bill doesn’t matter. You apparently don’t understand SEO or the ramifications of actions. You’re the one destroying Alex’s future by continuing to comment and come here. Alex, your friends are idiots! Find new friends!

      • peaceetc

Bill (or whomever), we have no desire to bring Alex down. If you would actually read the posts here, you would find we are actually trying to help him. Alex engaged in copyright infringement, which is *illegal*. He could be sued for thousands of dollars for doing it. We are trying to help him understand what he did wrong, how to fix it, and how to do things properly in the future.

His age is irrelevant. Seventeen is more than old enough to be able to understand these concepts and to do the right thing.

So you (however many of you there are) are not helping by acting like this. How about you focus on the real issue, which is helping you (or your friend, or whatever) to not commit crimes and to actually learn how to do things right. Alex has some real talent, but if he keeps going the way he has, it will lead to nothing but ruin. If he does things right, he has a real shot at a good career.

      • KimJ

Oh I love these “Leave him alone” – yeah right , leave him alone to steal more photos. He stole, lied and lied some more. He should not be left alone. (Read back to other posts, it is a regular thing with photo thieves)

  • MPR1776

I think he missed this part of the book when he said it was legal to use the images, I believe the first paragraph explains it pretty much.

    • U Really That Dumb?

Now you’re a Jack-Hole for pointing it out!
      Jack-Hole (TM) 2014 by ME! 🙂

      • MPR1776

Si, a girl needs a hobby, dontcha know.

    • Lindsay11

      Nice find!

    • Who reads that part of the magazine??

      • MPR1776

        Obviously not Alex

  • MPR1776

I also find this particularly cute: His ‘All Rights Reserved’ statements on FB and yet he thinks it is ok to use other people’s work….

    • Lindsay11

The people who steal always seem to have the biggest watermarks and the most warnings on their pages. That is so weird to me!

      • captain-confuzzled

        LOLOL, that is SO true!!!

  • Alex

Guys please leave me out of this. When I showed my cousins this I had no idea they were gonna act like idiots. To say that im making FAKE names is rediculous. I would love to prove to you that not true but my cousin said something about someone blocked the wifi router ip address! Please just leave me out of this madness today. You said what you had to. Just leave at that PLEASE!

    • MPR1776

Can’t do it, just can’t do it, on your FB page you have feel free to share other people’s work that you modified, illegal to do that. And the sad part is I looked at the stuff you’ve actually done yourself, you are pretty good, you really don’t need to use another photographer’s stuff. But you are going to ruin your whole future over this, it’s just sad to watch.

    • U Really That Dumb?

      Alex,

As for leaving you out of this? Sorry, you got yourself in to this so you have to get yourself out. That includes dealing with friends and family. Explaining to them that you are a thief and committed fraud.

My suggestion, Shut down everything before it gets shut down for you. Delete everything including your Zenfolio account. But why you say… Because when Zen shuts it down for stolen works, you’ll be banned for life. You doing it might give you the opportunity to come back years from now and start over.

Back to your cousins… Yup, idiots. But likely you knew that way before today so again, all on you.

Who made up Kim? Who is she? Why hasn’t she responded? Sorry we doubt, but look at others and you’ll know why.

    • U Really That Dumb?

I forgot…there are a ton of people here waiting on an apology. Here and publicly.
Perhaps deleting everything from your business and personal page and putting up an apology would be a good start.

    • Lindsay11

Do you want to make it stop? Remove the photos. Apologize. Don’t do it again.

I happen to know someone has contacted your college. How much further do you really want this to go? I don’t say these things as threats, they are just facts. You have agency here, you can do something about it. Instead of whining and crying like a child, “act like an adult” and try to clean up your messes.

    • BullShite

These “cousins” need to know the truth. This is what your LIES have caused. Why you can’t remove the images, ADMIT publicly that you LIED and that you took things that didn’t belong to you, said they were yours and TRIED TO SELL SOME OF THEM (which is super-serious) NO ONE would be looking like damn fool.

    • Oh the cousin card that’s rich..

  • captain-confuzzled

to Alex, Alex’s friends, pastor, etc if any are reading this. Following along with what others have said, Alex shows some real potential with his work. Clearly, being called on the carpet here for copyright infringement is not fun. We all get that. But as a young man, you are lucky enough to have an opportunity to turn this into a truly positive, learning moment that will in the end, help grow your career and future possibilities. As others have mentioned, “the Internet doesn’t forget”. Think about what you want people to see in future years, perhaps your own children, when they find this story. Do you want them to see an angry young man, or to see a young man who stood up with honor and said, “now I understand how important copyright is” and become a beacon of light helping others to understand how much pain copyright infringement can cause. If you think about it for a second, you’ll realize that what seems to you like silly adults who are nit-picking and don’t have a life, really represent many, many hard working professionals who built their careers and art on their own backs and to have it stolen and used frivolously, causes real pain and in many cases loss of income. Is this really what you want to be known for? copyright infringement and stealing the work of other artists? I don’t think you do, and I for one, hope that you swallow your pride a little bit now (I know it is hard when you feel attacked – if you read carefully you will see that there is no attack, only a plea for you to behave honorably and legally), and embrace doing what is right. Honorable is a very good thing in this life to strive for. I know that you have the ability to walk through tough times. Many who end up being reported here, don’t have that strength and often simply fade away. I think there are many people here who would like to see you succeed with the talent you are showing. It is totally up to you. There is quite a large audience here. What do you really want to say to that audience now, to position your future? The opportunity is yours to take or lose.

    • Alex

See but they are nit-picking! One of the adults on hear threatened to make me lose everything I have, then called me stupid, then said im creating fake names. How do you listen to people like this! Had they been more like you in the beginning I would have loved to have said”Yes I have edited pics that were not mine, I didnt mean any harm just wanted to practice my editing skills, I understand copyright now and I will listen to you helpful people and take the pics down!” BUT instead, they decided to bring my personal life into it. They even found time to go to youtube to dislike a video of mine and yet im suppose to listen to these people!

      • MPR1776

None of which would have happened, Alex had you just said Sorry, period and taken down the images that are not yours to use. It’s that simple. Man-up, you understood copyright law enough to know to put ‘All Rights Reserved’ on the images you posted. And you could have asked any one of us for help after just saying you are sorry and we would have been glad to help you in any way we could. None of us here like seeing talent wasted or squandered away. Not many of the people out’d here have that talent, which is why they steal other photographers works. Have your HS buddies pose for you and use that for your composites, that way you know what lighting was used and you can replicate it in CS with the background. B & H on youtube has excellent tutorials for lighting, headshots, using single lighting and look up Glyn Dewis Photoshop on youtube, he’s a composite genius. And Google Doug Gordon if you want to see the consequences of one’s actions.

      • Lindsay11

Alex, I was very calm and helpful to you until you insulted me, threatened to beat me up (which you never apologized for btw!) and acted like an idiot. No one threatened, just stated facts. I wish you would do the right thing. I really do.

      • U Really That Dumb?

        Alex,

Yes, you have been VERY stupid! That is why we are here talking to you. Your first response was an attack. YOU stole yet you attacked? Let me know in ten years how that works for you.

As for responsibility, start taking it. Who are the people that are posting from your IP? Who all did you steal from? Where have you publicly apologized?

As for loosing everything? Yup! Again, that’s all you and the way YOU decide to deal with this. Had you done the right thing in the beginning none of this would have gone down. Again time to grow up and deal with the consequences of your actions. Including those of your friends and family since you haven’t been honest with them.

You want to learn composites? Follow Joel. He is another master. If you EVER get a chance to attend a workshop, DO IT! You will blow your mind in what he does, how he does it, and how much you’ll learn. He’s also one of the nicest people on earth. Just don’t talk about his hair!
I did a Google search for you: https://www.google.com/webhp?sourceid=chrome-instant&ion=1&espv=2&ie=UTF-8#newwindow=1&q=joel%20grimes

You have been given a ton of advice. I suggest you go through and read each and every comment. Even if they hurt, listen! DO what the people are telling you! The people here are not just people that care about photo theft, but many are some amazing photographers, with a few being big names you can only wish to be some day.

Oh, and PLEASE for the love of Pete! (a saying way before your time) APOLOGIZE!

        Remember: WWJD

      • captain-confuzzled

At this point, the information you need to do the right thing has been presented to you. You and I can’t control what other people say and do, only what we say and do. I was recently labeled a terrorist and other pretty harsh things on another forum, because I vocally supported rescuing a wildlife animal that was clearly injured, when the policy of the wildlife group was “no intervention – they are wild animals.” It is not fun to be called out on things, but how we behave and our own words and actions are what define us in the end. You ultimately have the power here to do the right thing. If you don’t, others, as they have said, will do their best to make sure that your actions can’t hurt their fellow professionals. You have your choices and they have theirs. It is really very rare on this site to see so many people remarking on the talent they see in someone who has been called out here. I mean REALLY rare. In that regard, you are a lucky young man, that in the midst of feeling the pain you caused, they can still point out your talent and root for your success. That is a remarkable gift to you. I hope you don’t waste it, and I, like others really wish for your success.

      • BullShite

You don’t end up on this page unless you refuse to take down images after being warned the first time. No one cares how old you are, people care about the rampant and unrepentant THEFT in their industry. They want you to have ACCOUNTABILITY, of which you have had none. “Practicing Editing Skills” IS OK….. claiming you took pictures you did NOT, and SELLING images that are not yours…. that is WRONG.

If you WANT to be a real professional someday, you do NOT jump the gun buy taking other people’s hard work, and claiming it is yours, OR setting up a “business” and advertising yourself as a pro.

You should be PRACTICING and setting up your PORTFOLIO.
You should NEVER TOUCH an image that you did not create yourself, PERIOD. Photography needs to be a HOBBY until you’ve DONE YOUR TIME like EVERYONE ELSE.

        • peaceetc

Yeah, that’s something we need to highlight — from what I understand, he was warned first about his unauthorized use of others’ work before this post ever came out, and he refused to take it down. It didn’t have to come to this, yet he chose to ignore those who contacted him. Alex could have avoided this whole thing if he’d just done the right thing in the first place.

      • Alex Alex Alex we know it’s you … You have a unique ipaddres. Obviously we know is a residential ipaddress from your internet provider and as usual of course you going to lie about it that will piss some of us off. Do you think your the only on that did this smh.
Don’t worry you can now play the hack, mother, father, siblings card .. They posted for you acting like someone else from the same ipaddress within the same few minutes/hours come on dude do not be a dumb ass

      • Justin Case

Alex, my man, you’ve got to take the good with the bad. You wanted to be more well known, well now you are. And it’s a good lesson to learn – take the easy way, and it will ALWAYS cost you in the end.

There are no short cuts. You’ve got talent. But by trying to cheat or be less than completely honest, you’re robbing yourself of a great deal of pleasure. Photography is a great opportunity to do lots of crazy, wonderful things as you learn. Don’t cheat yourself by trying to turn it into a business before you’re ready.

It’s an old cliché, but there is simply no substitute for experience. You seem to enjoy manipulating photos, and that’s fine, but how much prouder will you feel when you know that those images are 100% your own? That you, and you alone made them? I think no one here doubts you can do it if you try.

It’s not just that you have to be honest with us. What really matters is that you’re honest with yourself. Know that you’re not ready to start a business. There are so many spelling and grammar mistakes on your web page, you would never be taken seriously in a real negotiation. And without experience on the business side, you will again be setting yourself up for massive (and expensive) failure. Wait until you are ready, and then trust others with more expertise to help you with the things that you can’t do for yourself.

I mean this from my heart. I wish you well. I can’t apologize for the comments of others, nor should I, but I am sorry it got so out of hand. You still have some more mess to clean up here (and an apology for what I think was a misunderstood threat would go a long way) before you will convince most that you have really given yourself a new start. Even if you need a few days to let it all cool off, a true statement from you here will go a long way in helping your reputation.

Good luck, man. Hopefully you’ve got many years of creative life ahead of you.

    • MPR1776

You are right, I can see him up there with Glyn Dewis in a few years, he really doesn’t need to steal stuff, just learn and practice.

  • Ric New

After reading comments from Alex, Bill, Tony & Kim Johnson, I’d like to point out a few facts to everyone that is posting here. I think its safe to assume most of us believe they are all the same person. I’d like to show some evidence of that. Look at the writing style of each poster and they are very similar.
1: The one that stands out the most is the over and improper use of “!”.
2: “WIFI”, when mentioned, is spelled in lower case from different posters.
3: Several words (when I assume the poster is trying to emphasize a point) are in all caps.
4; About 50% of the post (from different posters) is missing the punctuation from the last sentence.
5: and of course, the most obvious, for some reason there are 4 different people on the same IP.
Just an observation. The very similar use of “!” is enough to convince me.

    • Lindsay11

Yeah, I don’t think any one buys that the people posting are anyone but Alex. Even then it doesn’t really matter. All that matters is Alex Burkhalter uses stolen photos and won’t remove them.

  • U Really That Dumb?

    Alex, Alex, Alex…
You STILL have stolen images up. What’s the deal buddy? Is it really that hed to figure out what you took and what you didn’t?

    • YEp … I think that is the problem … trying to figure out if he took the image or not. Its so many he forgot LOL

    • Melinda Potter

Really?! WTH?! I can’t believe after everything that’s been said he still has images up that aren’t his. I know we get stubborn stealers from time to time, but come on!
Alex, take down everything that you did not create entirely yourself. Everything! Don’t continue with this. It’s not the way to go

    • Lindsay11

Is it a case of too much ego or not enough experience or stubbornness? I keep flashing onto the fact that he is only 17. But I know my teenagers would never do this or act like this so it can’t just be his age. I don’t think he really realizes how serious it all is. It’s just a joke to him.

      • Alex

Yep I RE uploaded some of the images because I got permission from the photographers! One of the photographers LOVED the way I edited his picture and even went as far as emailing the model the link to my website! Thanks everyone for all your help! Have a great day!

        • Patrick Mitchell

So the photographer gave you permission to use the photos without proper credit to the photographer? Who is this generous person?

        • DUDE YOU ARE A F#$#KING LAIR!

Sorry that was my angry voice. I bet a months wages you dont have proof of that.

          • None

Well, you are a fuckin retard that is about to comment on a lot of porno videos with your unique name if you keep it up.

          • Lindsay11

OMG Joseph, isn’t this nice? I would love it if someone would select good porn out for me. I’m just too lazy.

          • U Really That Dumb?

You’re asking us to find you commercially available ‘porno videos’ (wait, who calls it that still? Not any teens or young adults I know. Likely someone older…) or you’re wanting us to make you personal ones from the cult circle-jerks?

          • DAMN YOU LINDSAY11! I was about to say that! 🙂

          • Helena

            *yawn*

          • BullShite

You realize someone could do that to you too Alex, right? One day you are going to look back on your behavior and be deeply, deeply ashamed by it.

          • U Really That Dumb?

You do realize that if caught you could be on the receiving end of a new ‘friend’ in jail, right?
Nope, probably not! You’re too damn stupid!
BTW: How’s that all working out for you this week?

          • U Really That Dumb?

            IP: 107.178.38.129

          • They are masking their IP address. We still know who it is 😛
            http://www.cloudmosa.com

          • U Really That Dumb?

            True Dat!

          • Wait I am in porn videos … COOL!

          • I am so disappointed I did a search on google with my name and the word “porn” my secret videos never showed up.

          • U Really That Dumb?

I tried to get in but they kept telling me no. When I asked why they said it was no big thing…

        • Lindsay11

Alex, I don’t want to say I don’t believe you but… I don’t believe you. You have shown yourself to have a passing acquaintance with the truth. How about showing us the email the photographer sent you gushing over your work?

Even then, I don’t believe you got permission from every single photographer in one day to post all their photos. Not buying it, bucko! I really wish you would take this seriously.

        • Marc W.

          Was it that hard?

          But. Yeah. Hard to believe.

        • Justin Case

Well Alex, I think that’s great. I still think you’ll get more pleasure and feeling of accomplishment when you create the image from scratch, with your own models and your own camerawork.

Which image was it, just out of curiosity? I’ve been looking at your page, but I don’t see any that were removed and then reloaded.

        • Christopher C.

          No you didn’t.

  • Lindsay11

I see our good friend Alex Burkhalter still has stolen photographs up. At least he took our suggestion to spell “photographs” correctly, so we know he can learn.

Alex, as @disqus_bwwST6ZMFE:disqus is fond of pointing out, this could cost you up to $150,000 per photo stolen. Do you have that kinda money lying around? Or maybe your parents do?

    • BullShite

He’s gong to think it’s real funny when one of these places decides to sue him….. or by-proxy his parents. 17 can be considered an adult, especially if this page is used against him.

      • peaceetc

And especially since he was clearly warned that what he’s doing is illegal. He can’t claim ignorance, because he actively participated in the discussion here, so we know he knows it’s wrong.

Oh, and Alex — don’t bother trying to delete your comments — they are saved in the backend of this commenting system, along with your IP information.

        • What else did he write..

          • peaceetc

Nothing new, I think. I just meant that if he read what I wrote and tried deleting his comments to protect himself it wouldn’t work.

  • U Really That Dumb?

Oh Alex… We are waiting on proof that you have the OK to post. Otherwise you best be taking them down immediately lest you want more trouble.

    • Christopher C.

He’s not going to do anything until something real comes down on him. Unfortunately that means one of the copyright owners taking legal action.

  • Sven

Let me ask a question here. If you have never talked to the owners of these photos either, are you not stealing them as well by posting them to this website? Do you have proof that every owner of “all” the photos on this site said you could post screenshots of their work here? Or are you just assuming they will not mind because you think you are doing them a good service. What if a photographer comes accross their work here while you decide to speak on their behalf unknowingly and considers you are stealing their work as well. Something to think about.

    • U Really That Dumb?

Posting them here is legal. The owners do not need to approve, nor can they file a suit over it. They may politely ask, but that’s not likely to happen since they don’t want their work stolen either!

      • Sven

So you are saying that the owners of theses photos do not need to approve permission for you or someone to post their work to your own or any other website? I’m sorry but I am not really understanding the difference in law here. Is there some sort of clause in the laws that say that you can’t steal someone elses photos and post them to a website “Unless you are defending them without their request?” Do you have a link to this legal information? I would like to read about it. You seem to know all the answers so you must have a link that you get this information from. There is a lot of stolen images posted to this website from what I’m gathering here. Just please post the link that exempts you from screenshot and posting other folks images. They don’t even know you are defending them without their consent. I would love learn all about the rules, I seem to be missunderstood perhaps. Forgive me if I need be corrected after you provide the link to this information. Thanks.

        • Sven

Someone should contact every photo owner on this website, inform them you are speaking on their account and let them know screenshots of their work is posted to this website without their consent, with you saying it’s legal for you to do so. Yet you will not provide the legal clauses to back up what you are saying here. Interesting irony!

          • Lindsay11

Someone should look up Fair Use.

          • Lindsay11

Also, Alex, (yeah, I’m ASSuming you are Alex) if you think we haven’t done our damnedest to look up every photographer who has been stolen from and alert them well…

Well, you didn’t even look up who you stole from! So of course you think we wouldn’t care. School is starting up soon, wouldn’t you rather worry about that? Remove the stolen photos and you won’t have to worry about this website!

          • Fair use | Editorial

Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include—

            (1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

            (2) the nature of the copyrighted work;

            (3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

            (4) the effect of the use upon the potential market for or value of the copyrighted work.

The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

The important bit here for our purpose is:

“the fair use of a copyrighted work, including such use … for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use),”

            Thanks for playing.

Also we inform the original authors that their work was stolen by the thieves. We want the original copyright holders to actually defend their rights.

“inform them you are speaking on their account”

When have we ever said that we speak on behalf of the original copyright holders?

          • Christopher C.

Except nobody here is speaking on behalf of the original photographers. Absolutely nobody. It’s simply a fair-use reporting of events.

          • doncalifornia

Owners of photographs have no more right to tell me not to report crimes against them, as the victim of a drunk driving accident has to tell the news not to cover the crime. Nobody is speaking on behalf of the victim; this site is uncovering and reporting violations of copyright.

        • Since you asked twice:

Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

Also, it;s sad that we have to do your homework for you. It would have taken you a couple of minutes to read the relevant sections of the copyright act.

          • Lindsay11

Yay I was right! BTW Eric, if you can check your other folder on fb I have sent you a msg 🙂

        • doncalifornia

yeah I’m just going to cut and paste my reply from above because I think it answers all your questions. And if you want a “source” to back us up, look at Copyright Law, it’s clauses regarding Fair Use, and then if you feel like it, delve into the history of legal decisions by the U.S. Supreme Court regarding the law and its fine details. In the meantime, here’s my answer to your first question above: “Actually Sven if I was reviewing a photographer’s work, and post an
example or two in my article, and linked back to their site or contact
info, that is Fair Use. In fact, that goes on all the time in the art
and photography world, and the music world. And so on. It is perfectly
legal, legitimate, and generally encouraged as vital communication
about the state or art or business. But if you did as your hypothetical
above, and posted virtually all of Eric’s photos to your site and wrote
“a little report” then really you’re not reviewing, you are displaying.
You are getting traffic to your site specifically by virtue of your
display of Eric’s work. People are coming not for your “little report”
but to scroll through Eric’s work. This is why Fair Use is limited to a
reasonable set of examples to go along with your review or your report.
If the work you are reviewing or reporting on is text, then short
quoted snippets are allowed, or paraphrasing to a larger extent as long
as proper attribution is applied. I can’t review a new novel, and post a
whole chapter to my site. Then I am just offering an opportunity for
people to read a whole chapter of a new novel without the copyright
holder getting paid. However, as part of a report or a review, or
argument, or news item, I can post quotes and snippets, like in a movie
trailer or a news item. Now, I am posting this reply on the assumption
that you didn’t really know all this. Your hypothetical makes it look
like you either didn’t think it through (and you really want to know),
or you don’t really want to learn and are just being contrary. Who
knows? In any case, Photo Stealers’ inclusion of examples of stolen
photos is part of legitimate reporting of criminal violations of
copyright. Photo Stealers does not host the original artists’ entire
portfolios here. I really hope you understand the difference. Cheers.”

    • They can make contact the admins and they would probably remove the work but not out of any legal obligation but out of respect.

The use made of the images here is covered under the “Fair Use” clauses of the copyright act.

We are reporting on the theft of the images and so the use is editorial in nature.

      • Sven

Hey Eric, so if I go to your site, download all your photos and post them all to my site, write a little report of them like an editor thats allowed?

        • captain-confuzzled

I don’t know Eric’s take, but yeah, if you did a review of my work, indicated it was my work, sure, why not? That’s called free speech.

        • Sure you can … Why can’t you see the difference ?

        • Yup. Up to a certain point.
Downloading ALL my images might be considered excessive.

Actually a lot of the posts will come about because the owner of the original photo has reported it to this page, and we do have a habit of tracking down people whose work has been stolen.

    • Christopher C.

There is a tremendous difference between posting photos and saying “This person is stealing these photos from this original artist, here is the original artist” and “LOOK AT THESE GREAT PHOTOS I TOOK.”

One is theft and misrepresentation, the other is honest community service. It’s a shame you can’t tell the difference.

    • Justin Case

So ‘Sven’ I have a question for you: why bring up this issue here? There are plenty of ways you could have found the answer to your question with a bit of research or actually talking to a copyright lawyer if you are really interested.

It is quite obvious that what Alex has done has absolutely nothing to do with the question you posted above, so instead of answering (again) your disingenuous question, I would ask why you bring it up here, in this post.

  • captain-confuzzled

Alex, pretty disappointed to see that you are still mis-representing your work and have chosen to continue down the less honorable path. Listing photographs in your gallery as portraits, when you did not take the picture of the person in the portrait, as well as continuing to imply that the composite work contains your photos (since they are in the photographs category on your website) is just wrong and I will worry for anyone that does business with you.
